Salvadoran writer and poet Carlos Bucio Borja held a press conference on the afternoon of Thursday, February 8, in which he provided details about his detention and what he experienced while in the cells of El Penalito in San Salvador.
Bucio Borja claimed that he was illegally and unfairly arrested for reading six articles of the Constitution of the Republic inside the voting center located at the Concha Viuda de Escalon School.
“As a result, I was arrested for three days illegally and unfairly, and this is confirmed by the fact that I was released yesterday and the charges were dismissed,” he mentioned.
The writer read the record in which the prosecution requested his release because the events could not be substantiated as a crime. “I request (the release) since, with the analysis of the initial investigations and in light of Article 249 of the Criminal Procedure Code, the events cannot be substantiated as a crime, so the Public Prosecutor’s Office could not sustain an accusation because it is an atypical event, and it is not possible to continue with the process,” he read.
Could sue the State
Bucio Borja also said that he is considering filing a counterclaim for being arbitrarily and illegally arrested. “I have considered it and am still considering it in this regard. I need proper legal advice, and if I do it, I want to do it correctly and effectively,” he assured.
“I believe it is of utmost importance that at this historic moment, Salvadoran citizens develop our civic sense because this civic sense and the intrinsic freedoms guaranteed to this citizenship in our current Political Constitution are seriously threatened by the dictatorship of Mr. Nayib Armando Bukele,” he added.
Various civil society organizations expressed their support for Carlos Borja and his family following the arrest. And although they also celebrated his release, they stressed that the writer’s arrest was a clear attack on freedom of expression.

El escritor y poeta salvadoreño Carlos Bucio Borja brindó la tarde de este jueves 8 de febrero una conferencia de prensa en la que dio detalles sobre su detención y lo que vivió mientras permaneció en las bartolinas de El Penalito, en San Salvador.
Bucio Borja aseguró que fue capturado de manera ilegal e injusta por haber leído seis artículos de la Constitución de la República al interior del centro de votación ubicado en el Centro Escolar Concha Viuda de Escalón.
“A partir de eso fui detenido durante tres días de manera ilegal e injusta y esto lo confirma el hecho de que fui liberado ayer y los cargos se sobreseyeron”, mencionó.
El escritor dio lectura al acta en el que la representación fiscal pidió su liberación porque los hechos no podían sustentarse como un delito. “Requiero (la liberación) ya que con el análisis de las diligencias iniciales de investigación y a la luz del artículo 249 del Código Procesal Penal los hechos no se pueden sustentar como delito, por lo que el Ministerio Público no podría sustentar una acusación por tratarse de un hecho atípico, por lo que no es posible continuar con el proceso”, leyó.
Podría demandar al Estado
Bucio Borja también dijo que está considerando presentar una contrademanda por haber sido capturado arbitraria e ilegalmente. “Lo he considerado y lo estoy considerando a este respecto. Necesito una debida asesoría jurídica y pues si lo llego a hacer , lo quiero hacer de una manera correcta y eficiente”, aseguró.
“Considero que es de suma importancia que en este momento histórico los ciudadanos y las ciudadanas salvadoreñas desarrollemos nuestro sentido ciudadano, porque este sentido ciudadano y las libertades intrínsecas garantizadas a esta ciudadanía en nuestra Constitución Política vigente están seriamente amenazadas por la dictadura del señor Nayib Armando Bukele”, añadió.
Diversas organizaciones de la sociedad civil expresaron su apoyo a Carlos Borja y su familia tras la detención. Y aunque también celebraron su liberación, recalcaron que el arresto del escritor fue un claro atentado a la libertad de expresión.
