Councilman Héctor Silva Hernández believes he is facing an unequal judicial process in the case of the lawsuit filed against him by the cyan deputy, Christian Guevara. “The process has had several irregularities, I can no longer expect to have a fair trial,” said Silva, during the interview on TVX this January 17th.
The most serious irregularity according to the defendant is related to what happened prior to the public hearing scheduled for December 14th last year, because his defense did not have access to the minutes of the evidence submission hearing before the day of the trial.
“They wanted us to go to the public hearing completely blind, without clarity on which evidence had been admitted and which had not been admitted, it’s impossible to defend oneself like that,” Silva stated.
This caused the councilman’s defense attorney to resign on the spot in the court, considering that “there simply were no conditions to be able to exercise a technical defense.”
After the resignation of the first lawyer, the accused claims that he managed to hire another jurist to defend him, but two days later, this lawyer resigned due to alleged threats related to his defense.
The confidentiality imposed by the court at the beginning of the judicial process is another aspect that the councilman of San Salvador considers abnormal.
“Now they are trying to manipulate, they are trying to say that I took too long to present the evidence. How was I going to present the evidence (publicly) if there was a total confidentiality of the case and I was going to be accused of judicial disobedience?” the defendant questions.
Silva and his defense attorney requested on four occasions that the court lift the confidentiality granted at the request of Deputy Guevara.
“Regardless of what happens in the trial, I believe that people already know the truth and precisely for that reason, there are more voices stating, not only what I said but even expanding on what I said,” he pointed out in reference to a journalistic investigation published by Focos magazine.
The Focos publication asserts in its investigation titled “Companies of the friends of the Nuevas Ideas faction leader received $6.9 million from the State” that seven companies led by businessmen linked to Deputy Guevara, the faction leader of Nuevas Ideas, won $6,987,903.06 in awards from the State over four years.
“79% were granted by government institutions led by officials who are members or are linked to the ruling party, including the San Salvador City Hall,” the publication specifically indicates.
On the other hand, Silva considers the process unequal after the last defense attorney requested the disqualification of the judge of the Sixth Sentencing Court of San Salvador, due to the alleged anomalies that “at times could be interpreted as even wanting to advance criteria,” he said, but the Third Chamber of Criminal Court rejected the request.
“We submitted that request and the Chamber responded to me in record time. It’s incredible the agility this process has had, that is, not even five months have passed since I was sued and this process is already in its final stage,” Silva expressed.
Héctor Silva: “Ya no puedo esperar a tener un juicio justo”
El concejal Héctor Silva Hernández considera que enfrenta un proceso judicial desigual en el caso de la demanda interpuesta en su contra por el diputado cian, Christian Guevara. “El proceso ha tenido varias irregularidades, ya no puedo esperar a tener un juicio justo” dijo Silva, durante la entrevista en TVX de este 17 de enero.
La irregularidad más grave según el demandado está relacionada a lo que sucedió previo a la vista pública programada el 14 de diciembre del año pasado, debido a que su defensa no tuvo acceso al acta de la audiencia de aportación de pruebas, antes del día del juicio.
“Querían que fuéramos a la vista pública totalmente a ciegas, sin tener claridad de qué prueba se habían admitido y de qué pruebas no se había admitido, así es imposible defenderse” manifestó Silva.
Esto provocó que el abogado defensor del concejal renunciara ahí mismo en el juzgado por considerar “que simplemente no había condiciones para poder ejercer una defensa técnica”.
Tras la renuncia del primer abogado, el acusado asegura que logró contratar a otro jurista para que lo defendiera, pero dos días después este renunció por supuestas amenazas con relación a su defensa.
La reserva de información impuesta por el juzgado al inicio del proceso judicial es otro de los aspectos que el concejal de San Salvador considera anómalos.
“Ahora se está tratando de manipular, se está tratando de decir que yo me tardé mucho en presentar las pruebas. ¿Y cómo iba a presentar las pruebas (públicamente) si había reserva total del caso y me iban a acusar de desobediencia judicial? cuestiona el demandado.
Silva y su abogado defensor solicitaron en cuatro ocasiones al juzgado que levantara la reserva otorgada a solicitud del diputado Guevara.
“Independientemente de lo que pasa en el juicio yo creo que la gente ya sabe la verdad y precisamente, por eso es que hay más voces planteando, no solo lo que yo dije, sino que incluso ampliando lo que yo dije” señaló en referencia a una investigación periodística publicada por la revista Focos.
La publicación de Focos asegura en su investigación titulada “Empresas de los amigos del jefe de fracción de Nuevas Ideas recibieron $6.9 millones del Estado” que siete empresas dirigidas por empresarios vinculados al diputado Guevara, jefe de fracción de Nuevas Ideas, ganaron en cuatro años $6,987,903.06 en adjudicaciones con el Estado.
“El 79 % fueron otorgadas por instituciones de gobierno dirigidas por funcionarios que son miembros o están ligados al partido oficialista, entre estas la Alcaldía de San Salvador.” indica puntualmente la publicación.
Por otra parte, Silva considera el proceso desigual después que el último abogado defensor solicitó la recusación de la jueza del Tribunal Sexto de Sentencia de San Salvador, debido a las supuestas anomalías que “en algunos momentos se podría interpretar como que se querer incluso adelantar criterios” dijo, pero la Cámara Tercero de lo Penal rechazó la petición.
“Presentamos esa solicitud y la Cámara me respondió en tiempo récord. Es increíble la agilidad que ha tenido este proceso es decir, no han pasado ni siquiera cinco meses desde que a mí me demandaron y este proceso ya está en su etapa final” manifestó Silva.
