Through social networks, the resolution of the San Francisco Gotera Court of Instruction circulated, which orders the provisional detention of the leftist politician and critic of the current government, Rubén Zamora Rivas, 88 years old, and other former directors of the Legislative Assembly of 1993, for having signed the amnesty law of that date in March, for which the court makes them accomplices in the El Mozote massacre and surrounding sites.

In addition, the Court orders the detention of former president Alfredo Felix Cristiani, since as president he sanctioned the aforementioned amnesty law.

“For all the above, legal provisions cited and in accordance with articles 1, 11, 12, 172, of the Constitution of the Republic; articles 1, 2, 16, 106, 247 and 248 of the Criminal Procedure Code/1973; articles 1.1, 8.1, and 25.1 of the American Convention on Human Rights, the undersigned judge Resolves: a: To decree provisional detention, against the accused LUIS ROBERTO ANGULO SAMAYOA, RUBEN IGNACIO ZAMORA RIVAS, RAUL MANUEL SOMOZA ALFARO, RAUL ANTONIO PEÑA FLORES, ALFREDO FELIZ CRISTIANI BURKARD, who are attributed the commission of the crime of personal concealment, an act that occurred on March 20, 1993”

“The act was consummated by presenting a bill in which a broad, absolute, and unconditional favor was granted to the defendants for the commission of crimes that occurred in the seven populations of northern Morazán, which constituted an act contrary to international commitments; said legal instrument was issued with the acquiescence of the accused Alfredo Fredy Cristiani Burkar; who served as president of the Republic, who sanctioned and ordered its publication to convert it into a mandatory instrument.”

The processed defendants favored, according to the resolution, are high-ranking officers implicated in the El Mozote case, being them: Juan Rafael Bustillo Toledo, Carlos Eduardo Cáceres Flores, Luis (Juan) Adalberto Landaverde Barrera, Oscar Córidova Hernández, César A. Ramírez, José Guillermo García, José Antonio Rodríguez Milina, Roberto Antonio Garay Saravia, Rafael S. Aguirre, José Mario Godínez Castillo, Mauricio Duque Lozano, Walter Salazar Martínez, and Juan E. Mendez Rodríguez.

In justifying the capture against some members of the Board of Directors of the Legislative Assembly and against former president Cristiani, the court points out: “Such officials, making illegitimate use of a mechanism (the power to legislate), arranged to inhibit those responsible from the action of justice which frustrated one of the most important purposes of any legal system, such as achieving justice, declaring through grace, amnesty the extinction of criminal and civil responsibility of those responsible, materializing the impunity of the facts that constitute serious violations of human rights to favor the responsible parties.”

The massacre of El Mozote and surrounding places was committed between December 11, 12, and 13, 1981, by the Atlacatl Battalion and other regiments from the eastern area.

Several of the military commanders are being processed in the Gotera Court of Instruction, first under the jurisdiction of Judge Jorge Guzmán Urquilla, who was removed when President Nayib Bukele ordered the removal of all judges over 60 years old, except those identified as pro-government.

Instead of Guzmán, Mirtala Portillo was appointed, who has ordered the captures of those described above.

The arrest order of the former directors of the Legislative Assembly of 1993, especially for Dr. Rubén Zamora, a severe critic of the Bukele government, gives a political twist to the El Mozote case.

Juzgado de Gotera ordena detención contra Rubén Zamora y otros exdirectivos de la Asamblea Legislativa de 1993

A través las redes sociales circuló la resolución del Juzgado de Instrucción San Francisco Gotera en la que ordena la detención provisional contra el político de izquierda y crítico del actual gobierno, Rubén Zamora Rivas, de 88 años de edad, y a otros exdirectivos de la Asamblea Legislativa de 1993, por haber firmado la ley de amnistía de marzo de esa fecha, y por lo cual el tribunal los hace cómplices de la masacre de El Mozote y sitios aledaños.

Además, el Juzgado ordena la detención contra el expresidente Alfredo Felix Cristiani, pues siendo presidente sancionó la mencionada ley de amnistía.

“Por todo lo antes expuesto, disposiciones legales citadas y de conformidad con los arts. 1, 11, 12, 172, de la Constitución de la República; arts. 1, 2, 16, 106, 247 y 248 del Código Procesal Penal/1973; arts. 1.1, 8.1, y 25.1 de la Convención Americana sobre Derechos Humanos, la suscrita jueza Resuelve: a: Decretase detención provisional, contra los imputados LUIS ROBERTO ANGULO SAMAYOA, RUBEN IGNACIO ZAMORA RIVAS, RAUL MANUEL SOMOZA ALFARO, RAUL ANTONIO PEÑA FLORES, ALFREDO FELIZ CRISTIANI BURKARD, a quienes se le atribuyen la comisión del delito encubrimiento personal, hecho ocurrido el 20 de marzo de 1993”

“El hecho fue consumado al presentar una iniciativa de ley en la cual se concretó un favorecimiento a los procesados de una gracia amplia, abosoluta e incondicional por la comisión de los delitos ocurridos en las siete poblaciones del norte de morazán, lo cual constituía un acto contrario a compromisos internacionales; dicho instrumento jurídico se emitió con la aquiescencia del imputado Alfredo Fredy Cristiani Burkar; quien fungía como presidente de la República, quien sancionó y ordenó su publicación para convertir la misma en un instrumento de carácter obligatorio”.

Los procesados favorecidos, de acuerdo con la resolución, son oficiales de alto rango imputados en el caso de El Mozote, siendo ellos: Juan Rafael Bustillo Toledo, Carlos Eduardo Cáceres Flores, Luis (Juan) Adalberto Landaverde Barrera, Oscar Córidova Hernández, César A. Ramírez, José Guillermo García, José Antonio Rodríguez Milina, Roberto Antonio Garay Saravia, Rafael S. Aguirre, José Mario Godínez Castillo, Mauricio Duque Lozano, Walter Salazar Martínez y Juan E. Mendez Rodríguez.

Al justifica la captura contra a algunos miembros de la Junta directiva de la Asamblea Legislativa y contra el expresidente Cristiani, el tribunal señala: “Dichos funcionarios haciendo uso ilegítimo de un mecanismo (facultad de legislar) dispusieron inhibir a los responsables del accionar de la justicia lo cual frustruó uno de los fines más importantes de todo sistema jurídico, como es alcanzar la justicia, declarando por medio de la gracia, de la aminstía la extinción de la responsabilida penal y civil de los responsables, materializando la impunidad de los hechos que constituyen graves violaciones a derechos humanos para favorecer a losresponsables”.

La masacre de El Mozote y lugares aledaños fue cometida entre los días 11, 12 y 13 de diciembre de 1981, por el Batallón Atlacatl y otros regimientos de la zona oriental.

Varios de los mandos militares están siendo procesados en el Juzgado de Instrucción de Gotera, primero bajo la jurisdicción del Juez Jorge Guzmán Urquilla, quien fue removido cuando el presidente Nayib Bukele ordenó quitar a todos los jueces mayores de 60 años, salvo los identificados como progobierno.

En lugar de Guzmán fue nombrada Mirtala Portillo, quien ha ordenado las capturas de los arriba descritos.

La orden de captura de los exdirectivos de la Asamblea Legislativa de 1993, sobre todo por el doctor Rubén Zamora, un severo crítico del gobierno de Bukele, le da un giro político al caso de El Mozote.
