The commemoration of Human Rights Day and the 75th anniversary of the Universal Declaration of Human Rights, this December 10, takes place amid concerns about obvious setbacks in Human Rights in several regions and El Salvador is no exception, which in the last year and a half has drawn attention for the constant complaints of violations under the exception regime.

Different organizations have even taken cases of these violations to hearings at the Inter-American Court of Human Rights (IACHR). This is in addition to the transformations of the institutions that must protect human rights, penal reforms and what is considered as a “weakening” of the Human Rights Ombudsman’s Office (PDDH).

“And that it is not fulfilling its role of pointing out human rights violations, but rather diagnosing that everything is fine when it is evident that there are serious violations in the country,” said Ursula Indacochea, director of the Judicial Independence Program of the Due Process of Law Foundation (DPLF).

She added that at the level of international organizations they are evaluating whether there are elements to speak of cases against humanity, which are the most serious violations that would enable the competence of the International Criminal Court. This could have other effects for the country.

Conmemoración del día de los Derechos Humanos entre preocupaciones ante retrocesos

La conmemoración del Día de los Derechos Humanos y de los 75 años de la Declaración Universal de los Derechos Humanos, este 10 de diciembre, ocurre entre preocupaciones sobre evidentes retrocesos en Derechos Humanos en varias regiones y El Salvador no es la excepción, que en el último año y medio ha llamado la atención por las constantes denuncias de vulneraciones en el marco del régimen de excepción.

Incluso diferentes organizaciones han llevado casos de esas violaciones en audiencias en la Corte Interamericana de Derechos Humanos (CIDH). Esto se suma a las transformaciones de las instituciones que deben proteger los derechos humanos, reformas penales y lo que se considera como un “debilitamiento” de la Procuraduría para la Defensa de los Derechos Humanos (PDDH).

“Y que no está cumpliendo su rol de señalar cuáles son las violaciones a derechos humanos, sino mas bien dar diagnóstico de que todo está bien cuando es evidente que existen violaciones graves en el país”, dijo Úrsula Indacochea, directora del programa de Independencia Judicial de la Fundación para el Debido Proceso (DPLF, por sus siglas en inglés).

Agregó que a nivel de organizaciones internacionales evalúan si existen los elementos para hablar de casos de lesa humanidad, que son las violaciones más graves que habilitarían la competencia de la Corte Penal Internacional. Esto podría conllevar otros efectos para el país.
