The Supreme Electoral Tribunal (TSE) on Wednesday rejected the last revision appeals filed by opponents such as the Nuestro Tiempo party and lawyers seeking to annul the presidential candidacy of the current president, Nayib Bukele.
This was confirmed by a source from the TSE, who indicated that the appeals were rejected with four votes in yesterday’s session. However, the Tribunal is yet to notify the plaintiffs.
The president of the Nuestro Tiempo party, Andy Failer, reacted and said they would exhaust other avenues.
“We would not appeal to the Court, because this is a Court that was not legitimately elected; they are usurping those positions through a clear act of authoritarianism. The only thing we would contemplate in the near future is the international instance,” Failer told this newspaper.
He said they do not rule out turning to an international instance as the next step: “The option of the International Court is important to record the legal breakdown of our Constitution at an international level.”
For his part, anticipating a rejection of the appeals presented, earlier Failer, and constitutional lawyer Enrique Anaya, expressed that they will continue with the institutional appeals available. “From Nuestro Tiempo we have been forceful and have said that we are going to exhaust all the institutional resources available against this unconstitutional candidacy,” Failer said yesterday in the YSUCA radio interview.
The president of the political institute indicated that they are waiting to be notified by the TSE about the fourth document presented this week in which they reiterated that Bukele violates the Constitution with immediate reelection.
He mentioned that of the four appeals they presented, one was rejected because Bukele had not yet requested to be registered as a candidate and the second because the Tribunal had not issued the registration resolution. The third document was presented requesting the nullity of the registration, which was also rejected.
Failer added that “the magistrates are not clear about which articles of the Constitution the president is violating with this illegal candidacy.”
Meanwhile, Anaya commented that he sees in the Tribunal’s actions a “tendency to favor the Executive” in forcing the norms. “That is why our petitions and our appeals are always declared inadmissible, because they avoid getting to the heart of the matter,” said the constitutional lawyer.
Anaya also criticized that the TSE did not follow the process that involves a 24-hour deadline for the admission of a petition, giving a hearing to the plaintiff and the candidate in question before issuing a rejection resolution.
TSE rechaza últimos recursos que pedían anular la candidatura de Nayib Bukele
El Tribunal Supremo Electoral (TSE) rechazó el miércoles los últimos recursos de revisión presentados por opositores como el partido Nuestro Tiempo y abogados para solicitar la anulación de la candidatura presidencial del actual mandatario, Nayib Bukele.
Así lo confirmó una fuente del TSE, que indicó que los recursos fueron rechazados con cuatro votos en la sesión de ayer. No obstante, aún está pendiente que el Tribunal notifique a los demandantes.
El presidente del partido Nuestro Tiempo, Andy Failer, reaccionó y dijo que agotarán otras instancias.
“No recurriríamos ante la Sala, porque esta es una Sala que no fue electa legítimamente; están usurpando esos puestos por medio de claro acto de autoritarismo. Lo único que contemplaríamos en un futuro cercano es la instancia internacional”, dijo Failer a este periódico.
Dijo que no descartan recurrir a instancia internacional como siguiente paso: “La opción de la Corte Internacional es importante para dejar constancia del rompimiento jurídico de nuestra Constitución, a nivel internacional”.
Por su parte, previendo un rechazo de los recursos presentados, más temprano Failer, y el abogado constitucionalista Enrique Anaya, expresaron que continuarán con los recursos institucionales que estén disponibles. “Desde Nuestro Tiempo nosotros hemos sido contundentes y hemos dicho que vamos a agotar todos los recursos institucionales disponibles frente a esta candidatura inconstitucional”, dijo Failer ayer en la entrevista de radio YSUCA.
El presidente de dicho instituto político indicó que están a la espera de ser notificados por el TSE sobre el cuarto escrito presentado esta semana en el que reiteraron que Bukele viola la Constitución con la reelección inmediata.
Mencionó que de los cuatro recursos que presentaron , uno fue rechazado porque Bukele aún no había pedido ser inscrito como candidato y el segundo porque el Tribunal no había emitido la resolución de inscripción. El tercer escrito se presentó pidiendo la nulidad de la inscripción, el cual también fue rechazado.
Failer agregó que “a los magistrados no les queda claro cuáles son los artículos de la Constitución que está violando el presidente con esta candidatura ilegal”.
Mientras que Anaya comentó que observa en la actuación del Tribunal una “tendencia a favorecer al Ejecutivo” en forzar las normas. “Por eso es que siempre nuestras peticiones y nuestros recursos los declaran improcedentes, porque ellos evitan entrar al fondo del asunto”, manifestó el abogado constitucionalista.
Anaya también criticó que el TSE no haya seguido el proceso que implica el plazo de 24 horas para la admisión de una petición, dar audiencia la demandante y al candidato señalado antes de emitir una resolución de rechazo.
