Constitutional lawyers Enrique Anaya and José Marinero, along with members of the political party Our Time, again sought legal avenues in the Supreme Electoral Tribunal (TSE) for the body to adhere to national and electoral laws and not register the presidential candidacy of New Ideas (NI), formed by Nayib Bukele and Félix Ulloa.
“What we promised, we delivered, so with José Marinero we have already filed a review appeal against the rejection of the annulment appeal against Bukele’s unconstitutionality,” Anaya shared on social networks.
Marinero explained that the appeal is based on three reasons: the first is that the owner magistrates were part of the decision to reject the annulment, the second was that they consider it a premature and improper decision on their arguments at the beginning of the annulment procedure, and third, due to the violation of the annulment appeal procedure.
“The TSE resolved out of time (9 days later) and without following the legal phases. They invented the procedure. Although remote, the TSE can still correct if it examines our appeal responsibly,” Marinero pointed out.
According to Marinero, there are no more resources in the Electoral Code to request the annulment of the candidacy.
Anaya regretted that the TSE is an entity “captured by the Presidential House”, but that they still filed the appeals, “so that there is historical evidence of the people who through the institutions abjured their personal dignity and agreed to stain their hands with blood, as they have supported a dictatorship”.
Nuestro Tiempo Presented a New Appeal
The opposition political party Our Time also submitted a review request to the response of “improper” to the request for annulment of NI’s presidential candidacy, received by the Tribunal.
“For some magistrates of the TSE, it has not been clear which articles of the Constitution of the Republic the unconstitutional re-election violates. So we presented a review appeal, until it becomes clear,” said the party’s president, Andy Failer.
Failer recalled that the TSE magistrates responded that it was not clear what had been the object of the challenge they raised as a party.
“In the political duty of the second ordinal of article 73 (constitutional) that dictates the obligation to ensure compliance with the Constitution of the Republic,” established Our Time to continue with the process.
The Tribunal has a period of 24 hours to respond, but constitutionalists fear that there will be a delay in issuing a response, as has happened with other appeals previously presented.
The arguments with which lawyers, civil society, candidates for public office, and political parties have been supported are legal, based on the Constitution of the Republic and the electoral laws.
Abogados y Nuestro Tiempo piden al TSE revisión de sus resoluciones por candidatura de Bukele
Los abogados constitucionalistas Enrique Anaya y José Marinero, además de miembros del partido político Nuestro Tiempo, volvieron a buscar las vías legales en el Tribunal Supremo Electoral (TSE) para que el organismo se apegue a las leyes nacionales y electorales y no inscriba la candidatura presidencial de Nuevas Ideas (NI), formada por Nayib Bukele y Félix Ulloa.
“Lo prometido es deuda, así que con José Marinero ya cumplimos, interpusimos recurso de revisión contra el rechazo del recurso de nulidad contra inconstitucionalidad de Bukele”, compartió Anaya en redes sociales.
Marinero explicó que el recurso se basa en tres motivos: el primero de ellos es que los magistrados propietarios formaron parte de la decisión de rechazar la nulidad, el segundo fue que consideran fue una decisión prematura e indebida sobre sus argumentos al inicio del procedimiento de la nulidad, y tercero, por la violación al procedimiento del recurso de nulidad.
“El TSE resolvió fuera de plazo (9 días después) y sin seguir las fases de ley. Se inventó el procedimiento. Aunque sea remoto, el TSE aún puede corregir si examina nuestro recurso con responsabilidad”, señaló Marinero.
Según Marinero, no quedan más recursos en el Código Electoral para solicitar la nulidad de la candidatura.
Anaya lamentó que el TSE es una entidad “capturada por Casa Presidencial”, pero que aún así interpusieron los recursos, “para que quede evidencia histórica de las personas que a través de las instituciones abjuraron de su dignidad personal y aceptaron manchar de sangre sus manos, pues han apoyado una dictadura”.
Nuestro Tiempo presentó nuevo recurso
El partido político Nuestro Tiempo, de oposición, presentó también una solicitud de revisión a la respuesta de “improcedente” a la solicitud de nulidad de la candidatura presidencial de NI, recibida por el Tribunal.
“Para algunos magistrados del TSE no ha quedado claro qué artículos de la Constitución de la República viola la reelección inconstitucional. Así que presentamos un recurso de revisión, hasta que quede claro”, manifestó el presidente del partido, Andy Failer.
Failer recordó que los magistrados del TSE respondieron que no quedaba claro cuál había sido el objeto de la impugnación que plantearon como partido.
“En el deber político dl ordial segundo del artículo 73 (constitucional) que dicta la obligación de velar por el cumplimiento de la Constitución de la República”, estableció Nuestro Tiempo para continuar con el proceso.
El Tribunal cuenta con un plazo de 24 horas para dar respuesta, pero los constitucionalistas temen que se vaya a retrasar en emitir una respuesta, tal como ocurrió con otros recursos antes presentados.
Los argumentos con los que los abogados, la sociedad civil, candidatos a cargos públicos y partidos políticos se han apoyado son jurídicos, tomando de base la Constitución de la República y las leyes electorales.
