The four magistrates of the Supreme Electoral Tribunal (TSE), who endorsed the resolution to register the illegal candidacy of the current president, have made a decision “in complicity” with the dictatorial project of the Salvadoran president.
Lawyer José Marinero stated this after presenting a review appeal last Monday against the resolution issued by the TSE, which rejected two petitions he presented along with constitutional lawyer Enrique Anaya, on October 26 and 27.
In the documents, the lawyers requested the denial of the ticket registration nominating the current president as a candidate for the Presidency, for being unconstitutional.
The Tribunal declared this request inadmissible under the argument that as of November 1 “there was no procedure in process” to register the head of state, the lawyers explain. However, the lawyers reject such justification and point out inconsistencies in the indicated dates.
The legal experts also requested that four proprietary magistrates and one substitute from the TSE be recused from the decision to register the illegal candidacy of the Salvadoran president because, in their opinion, the officials had already advanced criteria.
Marinero reproaches that the magistrates ignored the petition, decided to know about their own recusal, and, furthermore, ended up declaring the appeal inadmissible. Meanwhile, Anaya described the TSE’s decision as “absurd.”
This Tuesday, both lawyers presented a new annulment appeal against the presidential candidacy of the president, registered with four out of five votes of the TSE, on November 3.
Marinero emphasizes that this appeal is directly against the illegal registration. Anaya says that these actions are taken as part of a civic struggle against the ruling party’s intent to perpetuate itself in power.
In Marinero’s opinion, the electoral judges are disregarding the Constitution and the citizens’ rights to clean, fair, and competitive elections. He emphasized that the magistrates have already decided what role they want to play and on which side of history they want to stand.
“With these petitions, there will be a written record of which side the Tribunal was on during this era, which seems to indicate that the authoritarian project is finally consolidated,” concluded José Marinero.

Los cuatro magistrados del Tribunal Supremo Electoral, TSE, que suscribieron la resolución de inscripción de la candidatura ilegal del actual mandatario han adoptado una decisión “en complicidad” con el proyecto dictatorial del presidente salvadoreño.
Así lo afirmó el abogado José Marinero tras presentar el pasado lunes un recurso de revisión contra la resolución emitida por el TSE en la que rechazó dos peticiones que presentó él junto al abogado constitucionalista Enrique Anaya, el pasado 26 y 27 de octubre.
En los escritos, los juristas pedían que se negara la inscripción de la planilla que postula al mandatario actual como candidato a la Presidencia, por ser inconstitucional.
El Tribunal declaró improcedente tal solicitud bajo el argumento de que al 1 de noviembre “no había ningún procedimiento en trámite” para inscribir al jefe de Estado, explican los abogados. Pero, los juristas rechazan tal justificación y señalan incoherencias en las fechas indicadas.
Los expertos en derecho también pedían que cuatro magistrados propietarios y un suplente del TSE fueran recusados de la decisión de inscribir la candidatura ilegal del presidente salvadoreño porque, a juicio de ellos, los funcionarios ya habían adelantado criterio.
Marinero reprocha que los magistrados ignoraron la petición, decidieron conocer sobre su propia recusación y, además, terminaron declarando improcedente el escrito. Mientras que Anaya calificó la decisión del TSE como “un absurdo”.
Este martes, ambos abogados presentaron un nuevo recurso de nulidad contra la candidatura presidencial del presidente, inscrita con cuatro de cinco votos del TSE, el pasado 3 de noviembre.
Marinero destaca que este recurso es contra la inscripción ilegal directamente. Anaya dice que estas acciones se hacen como parte de una lucha ciudadana ante el propósito del oficialismo de perpetuarse en el poder.
A juicio de Marinero, los jueces electorales están desconociendo la Constitución, así como los derechos ciudadanos a unas elecciones limpias, justas y competitivas. Remarcó que los magistrados ya han decidido qué rol quieren jugar y de qué lado de la historia quieren estar.
“Con estas peticiones quedará registro por escrito de qué lado estaba el Tribunal en esta época en que todo parece indicar que se termina de consolidar el proyecto autoritario”, concluyó José Marinero.
