According to Andy Failer, president of NT, the TSE had declared inadmissible a request filed because the resolution of Nayib Bukele’s registration had not been published.”In the afternoon of yesterday (Monday, November 7), the resolution and the inscription of that presidential formula is published and in view of that we have presented (today) the brief in which we are requesting the nullity of the inscription”, added Failer, whom Luis Parada, NT presidential candidate, accompanied.
He added that they have also requested the recusal of the magistrates who voted for the registration of the presidential candidate of the ruling party Nuevas Ideas (NI). For his part, Enrique Anaya, constitutional lawyer, presented again this Tuesday a document and indicated that this is the fourth time that they have presented an appeal for nullity, but so far none of them has been admitted.
The lawyer, accompanied by attorney José Marinero, argued that “Mr. Bukele’s candidacy is unconstitutional, because our Constitution in at least 7 constitutional provisions states that immediate presidential reelection is prohibited”.He pointed out that the resolution that supposedly endorses the reelection issued by the Constitutional Chamber of the Supreme Court, which in his opinion is taken by “usurpers”, is “spurious”.
Removal of Constitutional Chamber magistrates in 2021 and replaced by pro Bukele
Lawyers, social organizations and the international community rejected in 2021 the dismissal of the judges of the Constitutional Chamber and their replacement by former advisors of the Bukele government and lawyers of high-ranking officials without following the legal process after the installation of the Congress with a large pro-government majority.
The judges, pointed out by the United States of being “loyal” to Bukele’s Executive, pointed out that the prohibition of immediate reelection is for a ruler who has been in power for 10 years, contrary to the criteria established by a previous chamber that indicated that a president must wait two lustrums to opt again for the position.
The TSE agreed on Friday to register Bukele’s presidential candidacy for NI to seek immediate reelection in February 2024, despite claims of unconstitutionality and several requests to reject it.

De acuerdo con Andy Failer, presidente de NT, el TSE había declarado improcedente una solicitud presentada a raíz de que no se había publicado la resolución de la inscripciónde Nayib Bukele. “En la tarde del día de ayer (lunes 7 de noviembre), se publica la resolución y la inscripción de esa formula presidencial y frente a eso hemos presentado (hoy) el escrito en el que estamos solicitando la nulidad de la inscripción”, agregó Failer, quien fue acompañado por Luis Parada, candidato presidencial de NT.
Agregó que además han pedido que se recuse a los magistrados que votaron por la inscripción de la formula presidencial del partido oficialista Nuevas Ideas (NI). Por su parte, Enrique Anaya, abogado constitucionalista, presentó de nuevo este martes un escrito e indicó que es la cuarta vez que presentan un recurso de nulidad, sin que hasta ahora ninguno haya sido admitido.
El letrado, que estuvo acompañado por el abogado José Marinero, sostuvo que “la candidatura del señor Bukele es inconstitucional, porque nuestra Constitución en al menos 7 disposiciones constitucionales señala que están prohibida la reelección presidencial inmediata”. Señaló que la resolución que supuestamente avala la reelección emitida por la Sala de lo Constitucional de la Corte Suprema, que a su juicio está tomada por “usurpadores”, es “espuria”.

Abogados, organizaciones sociales y la comunidad internacional rechazó en 2021 la destitución de los magistrados de la Sala de lo Constitucional y su sustitución por exasesores del Gobierno de Bukele y abogados de altos funcionarios sin seguir el proceso legal tras la instalación del Congreso de amplia mayoría oficialista.
Los jueces, señalados por Estados Unidos de ser “leales” al Ejecutivo de Bukele, apuntaron que la prohibición de la reelección inmediata es para un gobernante que haya estado en el poder por 10 años, criterio contrario al que estableció una sala anterior que indicaba que un presidente debía esperar dos lustros para optar nuevamente por el cargo.
El TSE acordó el viernes inscribir la candidatura presidencial de Bukele por NI para que busque la reelección inmediata en febrero de 2024, a pesar de los señalamientos de inconstitucionalidad y de varias solicitudes para que la rechazara.
