According to constitutional lawyer Enrique Anaya, the upcoming 2024 electoral process will have a “peculiarity” only seen in Salvadoran dictatorships. This is in reference to the current President of the Republic, Nayib Bukele, stating that he will register in the coming days to run for president for the 2024-2029 term, despite the Constitution’s prohibition against it.
“Bukele’s candidacy is unconstitutional,” the lawyer declared, considering that by October 26 at the latest, the current leader would attend the Supreme Electoral Tribunal (TSE) to submit his application.
Additionally, Bukele, as both president and potential candidate, would be using all the resources of the State for the benefit of his image, “and will continue to do so,” assured Anaya.
“Let’s suppose Bukele registers on the 26th, will he be both president and candidate? There we have the first distortion,” posed the expert during the morning interview on Canal 21.
According to Anaya, from the day Bukele announced his desire to remain in power, he began using state media to his advantage. He recalled that on September 15, during the celebration of Independence, Bukele chose to announce his re-election intentions on a national network.
Anaya pointed out that there is no “procedure” in the laws about the timeframes a leader should step down to dedicate himself to his electoral campaign, for the sole reason that consecutive presidential re-election is prohibited. And the Constitution is clear on this matter.
“It is stipulated that there can be no re-election, and since it is stipulated that there will be no re-election, everything else about resigning or asking for leave… it’s all going to be made up. Any excuse will be made up,” he clarified.
“I don’t know where they got the idea that the president is going to resign; he is not going to resign, especially if the same ruling from the usurpers (current Supreme Court justices) is that he can stay until he asks for a leave of absence six months prior,” he reinforced.
Popularity Is Not Above the Law
During the interview, the constitutionalist was asked about the argument used by Nuevas Ideas to try to justify Bukele’s illegal re-election, saying it responds to a “popular desire,” given the popularity the leader would have gained through his security policy.
Based on legal arguments, Anaya explained that it’s not a question of popularity but legality in a democratic system.
“In a constitutional democracy, it is essential to follow the rules,” Anaya concluded.
He warned that after a possible re-election of the current president, he would seek to reform the Constitution, further undermining democracy and securing more years in office.

Para el abogado constitucionalista Enrique Anaya, el próximo proceso electoral de 2024 tendrá una “peculiaridad” que solo se ha dado en las dictaduras salvadoreñas. Esto en referencia a que el actual presidente de la República, Nayib Bukele, asegura que se inscribirá en los próximos días para ser candidato a presidente para el periodo 2024-2029, y así reelegirse, pese a la prohibición de la Constitución.
La candidatura de Bukele es inconstitucional, zanjó el jurista, ante el escenario próximo que a más tardar el 26 de octubre, el actual mandatario asistiría al Tribunal Supremo Electoral (TSE) a presentar su solicitud.
Además Bukele, como presidente y potencial candidato, estaría usando todos los recursos del Estado en beneficio de su imagen, “y lo va a seguir haciendo”, aseguró Anaya.
“Supongamos que Bukele llega el 26 a inscribirse, ¿va a ser presidente y candidato? Ahí tenemos la primera distorsión”, planteó el experto en la entrevista matutina de Canal 21.
Según Anaya, desde el día en que Bukele anunció su deseo de perpetuarse en el poder, comenzó a utilizar los medios estatales para favorecerse. Recordó que fue un 15 de septiembre, en plena celebración de la Independencia, la fecha que Bukele escogió para anunciar en cadena nacional sus intenciones de reelegirse.
Anaya recordó que no se encontrará en las leyes un “procedimiento” sobre los plazos en que un mandatario debiera abandonar el cargo para dedicarse a su campaña electoral, por la única razón de que la reelección presidencial consecutiva está prohibida. Y la Constitución es clara al respecto.
“Está previsto que no puede haber reelección, y como está previsto que no habrá reelección, esto de que si renuncia, que si pide licencia… todo va a estar inventado. Cualquier excusa va a ser inventada”, aclaró.
“No sé de dónde se han inventado que el presidente va a renunciar, no va a renunciar, si la misma resolución de los usurpadores (actuales magistrados CSJ) es que va hasta que pida licencia seis meses antes”, reforzó.
Popularidad no está encima de lo legal
Durante la entrevista, al constitucionalista se le consultó sobre el argumento usado por el oficialismo para intentar justificar la reelección ilegal de Bukele, al decir que esta responde a un “deseo popular”, ante la popularidad que el mandatario se habría ganado a través de su política de seguridad.
Con base a argumentos legales, Anaya explicó que no es una cuestión de popularidad, sino de legalidad en un sistema democrático.
“En una democracia constitucional es esencial cumplir las reglas”, concluyó Anaya.
Advirtió que tras una posible reelección del actual mandatario, este buscaría reformar la Constitución, socavando aún más la democracia y garantizarse más años en el cargo.
