A complaint detailing at least 200 cases of human rights violations committed against people detained under the state of emergency is currently being analyzed by the Inter-American Commission on Human Rights (IACHR), stated Ovidio Mauricio, the director of the Human Rights Association Tutela Legal “Dra. María Julia Hernández,” during a TVX interview.
Mauricio explained that in response to the complaint filed by Tutela Legal, the IACHR requested a report from the Salvadoran state, which replied with “lies.” “They’ve responded with pure lies, saying they are providing the best healthcare to the prison population, better than what is available outside,” he stated.
The director of Tutela Legal revealed that no organization working in defense of human rights has been allowed to know the situation of those deprived of freedom, but testimonies from people who have been provisionally released indicate that torture is being committed.
“We have received extremely serious testimonies; there are tortures and issues of terror threats,” he confirmed.
Mauricio recalled that the only entity allowed by law to enter and verify the conditions of those deprived of freedom is the Human Rights Ombudsman’s Office (PDDH), but it has not done so.
“It’s a sham because they are doing nothing to defend the rights of those people who are being violated. They could be the ones to do it, as the law allows, yet they have sided with the executive branch, with the government,” lamented Mauricio.
In a work report presented by Ombudsman Raquel Caballero to the Legislative Assembly on July 27, she stated that her powers “have been restricted” by the implementation of the state of emergency.
When questioned about the role of the Presidential Commissioner for Human Rights and Freedom of Expression, Colombian Andrés Guzmán Caballero, Mauricio said, “It’s a joke.”
“That commissioner is a joke to me; I believe he has no experience in human rights, and what they have done is to restrain and confuse people, but he is doing nothing to defend human rights. What he is doing is justifying what the executive branch does,” he pointed out.
Released Due to Illness
Regarding people who have been released from prison, Mauricio explained that most are under alternative measures to detention while awaiting their final hearing where it will be decided whether or not they are convicted. On the other hand, he said they have analyzed the cases and deduced that many have been released because they are very sick and there is a fear that they may die in prison.
He also stated that Tutela Legal has filed around 400 habeas corpus petitions with the Supreme Court of Justice (SCJ), and part of their precautionary measures is to know what illnesses the detainee suffers from. “Some of these have been released because of illness, fearing they may die inside; that’s what we have deduced from many cases we have, and that have come out,” he emphasized.
Mauricio explained that we are in a justice system co-opted by the Executive, from prisons, the Attorney General of the Republic, the courts, the entire justice body. “These are executive orders because that’s what they do. At some point, these judges who have committed these atrocities, making arrests without any evidence, will be prosecuted, even magistrates. Hopefully, one day real justice will be done in this country,” he concluded.
International Recognition
On October 18, the Human Rights Association Tutela Legal “Dra. María Julia Hernández” received the Letelier Moffit Award, given by the Institute for Policy Studies (IPS) for their work in defending human rights in El Salvador for 40 years.
“We suffer and are suffering the same military oppression that Chile and the entire region experienced a few decades ago under military dictatorships,” said Alejandro Díaz, a lawyer for Tutela Legal, during the award recognition.
The award given to Tutela Legal was created in memory of Chilean opposition member Letelier Moffit and American activist Ronni Karpen Moffit, who were killed on September 21, 1976, during the dictatorship of Augusto Pinochet.
“The history of the people is an invaluable heritage so that memory is not forgotten. In El Salvador, through current government officials, they want to destroy and hide this heritage; there is a denial of history,” added Díaz.
“Es un chiste”, dice director de Tutela Legal sobre el comisionado presidencial de derechos humanos
Una denuncia con al menos 200 casos de violaciones a los derechos humanos, cometidas contra las personas que se encuentran detenidas por el régimen de excepción, está siendo analizada por la Comisión Interamericana de Derechos Humanos (CIDH), aseguró Ovidio Mauricio, director de la Asociación de Derechos Humanos Tutela Legal “Dra. María Julia Hernández”, durante la entrevista de TVX.
Mauricio explicó que ante la denuncia presentada por Tutela Legal, la CIDH le solicitó al Estado salvadoreño un informe sobre la situación, pero este contestó con “mentiras”. “Ha contestado puras mentiras, dice que está dando la mejor salud a la población en los penales, mejor que la que dan fuera”, manifestó.
El director de Tutela Legal expuso que no se ha permitido a ninguna organización, de las que trabajan en defensa de los derechos humanos, conocer la situación de las personas que se encuentran privadas de libertad, pero por los testimonios de personas que han sido liberadas de manera provisional indican que se están cometiendo torturas.
“Hemos recibido testimonios gravísimos, hay torturas y problemas de amenazas de terror”, aseguró.
Mauricio recordó que el único ente que puede ingresar y verificar las condiciones de los privados de libertad, porque la ley se lo permite, es la Procuraduría para la Defensa de los Derechos Humanos (PDDH), pero no lo hace.
“Es un cajón porque no está haciendo nada en la defensa por aquellas personas que están siendo violentadas en sus derechos humanos. Es la única que podría hacer y que la ley se lo permite, sin embargo, se ha puesto del lado del ejecutivo, del lado del gobierno”, lamentó Mauricio.
En un informe de labores presentado por la la procuradora Raquel Caballero ante la Asamblea Legislativa el 27 de julio pasado, aseguró que sus facultades “se han restringido” por la implementación del régimen de excepción.
El director de Tutela Legal al ser interrogado por el papel del comisionado presidencial para los Derechos Humanos y Libertad de Expresión, el colombiano Andrés Guzmán Caballero, dijo que “Es un chiste”.
“Ese es un chiste, para mi es un chiste ese comisionado, yo creo que ni experiencia tiene en derechos humanos y lo que han hecho es para detener y dar “garabato” a la gente, pero no está haciendo nada en defensa de los derechos humanos. Lo que está haciendo es, justificando lo que el poder ejecutivo hace”, señaló.
Liberados por enfermedades
En cuanto a las personas que han sido liberadas de los centros penitenciarios, Mauricio expuso que la mayoría están bajo medidas alternas a la detención, mientras esperan la última audiencia en la que se decidirá si los condenan o no.
Por otra parte, explicó que han analizado los casos y deducen que muchos de ellos han sido liberados porque están muy enfermos y temen que mueran dentro de las prisiones.
Asimismo dijo que como Tutela Legal han presentado unos 400 habeas corpus ante la Corte Suprema de Justicia (CSJ) y en las prevenciones que hace la Sala está el saber qué enfermedades padece el detenido.
“Algunos de esos han salido libres por la enfermedad, porque temen que se les muera adentro, porque hay peligro de muerte de esa persona. Eso hemos deducido de muchos casos que tenemos y que han salido”, enfatizó.
Mauricio explicó que estamos en un sistema de justicia cooptado por el Ejecutivo, desde centros penales, la Fiscalía General de la República, los tribunales, todo el órgano de justicia.
“Son ordenanzas del Ejecutivo, porque es lo que hacen. En algún momento estos jueces que han cometido estas barbaridades, hacer detenciones sin prueba alguna, van a ser procesados, incluso magistrados, ojalá que algún día se haga justicia verdadera en este país”, concluyó.
Reconocimiento internacional
El pasado 18 de octubre la Asociación de Derechos Humanos Tutela Legal Dra. María Julia Hernández recibió el premio Letelier Moffit, otorgado por el Instituto de Estudios Políticos (IPS, por sus siglos en inglés) por su trabajo en la defensa de los derechos humanos en El Salvador desde hace 40 años.
“Sufrimos y estamos sufriendo la misma opresión militar que vivió Chile y toda la región hace unas décadas bajo dictaduras militares”, expresó Alejandro Díaz, abogado de Tutela Legal, durante el renacimiento del reconocimiento.
El premio otorgado a Tutela Legal fue creado en memoria del opositor chileno Letelier Moffit y la activista estadounidense Ronni Karpen Moffit, asesinados el 21 de septiembre de 1976, durante la dictadura de Augusto Pinochet.
“La historia de los pueblos en un patrimonio invaluable para que no se olvide la memoria. En El Salvador a través de funcionarios actuales de gobierno quieren destruir y esconder este patrimonio, existe un negacionismo de la historia”,agregó Díaz.
