Deputies from Nuevas Ideas and the National Concertation Party (PCN) of the Foreign Relations Committee of the Legislative Assembly approved this Wednesday a favorable opinion on the “Law on the Integration of Functions of the National Council for the Protection and Development of the Migrant Person and their Family (CONMIGRANTES) to the Ministry of Foreign Affairs.” This would dissolve the council, and the resources for its operation would go to the Nation’s General Fund.
Currently, the Special Law on Migration and Aliens states in Article 326 that $1 from the revenue generated by the airfare tax per passenger will be allocated to the Council’s assets. With the new law, this funding will go to the Nation’s General Fund.
“To ensure effective compliance with the provisions of this law, the Ministry of Finance is authorized to issue the necessary administrative and financial provisions,” says the bill.
Regarding income, Patricia Aguilera Bran, Director of Legal Affairs at the Ministry of Foreign Affairs, told deputies that the Ministry has its own Special Activities Fund and budget for migrant care activities, which will be available to the Ministry of Finance.
“What we are asking is that the article that establishes that CONMIGRANTES can be funded with a specific fund, that this fund goes to the Nation’s General Fund and that it is the Ministry of Finance that determines what good use can be given to it,” said Patricia Aguilera Bran.
The draft decree declares the dissolution of CONMIGRANTES, a public law entity, non-profit, created through the “Special Law for the Protection and Development of the Salvadoran Migrant Person and their Family,” approved in 2011; which will also be repealed.
This dissolution would add to seven other institutions dissolved at the government’s request, including the Export and Investment Promotion Agency of El Salvador (PROESA), replaced by the Investment and Export Promotion Agency of El Salvador (INVEST). It also requested the dissolution of the Salvadoran Institute for Professional Training (INSAFORP) and the National Youth Institute (INJUVE) with the proposal of the “National Integration System Law,” which has not yet been approved by the Legislative Assembly.
It should be noted that CONMIGRANTES comprises governmental and non-governmental representatives, through associations of Salvadorans abroad; by universities and the private sector.
The Ministry of Foreign Affairs, through the Vice Ministry of Diaspora and Human Mobility, will succeed CONMIGRANTES in its functions, attributions, competencies, responsibilities, and obligations.
“The deadline for liquidation will be up to 60 calendar days, counted from the entry into force of this decree,” states the draft law.
It also establishes that staff performing Council-specific functions and whose duties “are essential” for the operation of the transferred responsibilities will maintain their employment relationship with the Ministry of Foreign Affairs for their “administrative relocation.”
Furthermore, the Ministry will be authorized to appoint a liquidation commission that will issue guidelines for the liquidation process of assets and liabilities and transfer functions to the Ministry.
The proposal entered the plenary session this Tuesday with the signature of some Nuevas Ideas deputies.
Double Functioning
To dissolve the entity, the ruling party argues that in 2021 the Vice Ministry of Diaspora and Human Mobility was created within the Ministry of Foreign Affairs, which would have within its functions the promotion and protection of the human rights of the migrant person.
“That’s where we see from its creation in 2021 where all the functions that were once thought to be created in CONMIGRANTES have been developed; but these were never really executed,” said Bran.
She added that CONMIGRANTES is attached to the Ministry of Foreign Affairs and its activities have to do with the Vice Ministry of Diaspora.
“That’s where we say why have a fund, which feeds CONMIGRANTES, and which is not being used; why have CONMIGRANTES created when we already saw that the functions are being done as they were created from the moment the Vice Ministry of Diaspora and Human Mobility was created, why duplicate efforts,” expressed Bran.
She argued that the Vice Ministry has more work programs and the Council “was ineffective.”
“It’s good that they are now going to take over CONMIGRANTES because why duplicate the work?” said Walter Alemán, a Nuevas Ideas deputy.
The dictum would go to the legislative plenary for approval in upcoming sessions.
Diputados avalan que se disuelva CONMIGRANTES y sus recursos pasen al Fondo General
Diputados de Nuevas Ideas y del Partido de Concertación Nacional (PCN) de la Comisión de Relaciones Exteriores de la Asamblea Legislativa aprobaron este miércoles el dictamen favorable a la “Ley de Integración de funciones del Consejo Nacional para la Protección y Desarrollo de la Persona Migrante y su Familia (CONMIGRANTES) al Ministerio de Relaciones Exteriores” con la que se disolvería dicho consejo y los recursos para su funcionamiento pasarán al Fondo General de la Nación.
Actualmente, la Ley Especial de Migración y Extranjería establece en el artículo 326 que de los ingresos generados por el cobro de la tasa por salida de cada pasajero vía aérea, se destinará $1 al patrimonio del Consejo. Con la nueva ley, ese financiamiento pasará al Fondo General de la Nación.
“Con la finalidad de garantizar un efectivo cumplimiento a lo dispuesto en la presente disposición, se faculta al Ministerio de Hacienda para que emita las disposiciones administrativas y financieras que sean necesarias”, dice la propuesta de ley.
Respecto a los ingresos, Patricia Aguilera Bran, directora de Asuntos Jurídicos de Cancillería, dijo a los diputados que el Ministerio de Relaciones Exteriores cuenta con su propio Fondo de Actividades Especiales y su presupuesto para las actividades para atención de la persona migrante, por lo que quedarán a disponibilidad del Ministerio de Hacienda.
“Lo que estamos pidiendo es que ese artículo que establece que puede alimentarse CONMIGRANTES con un fondo específico, que este fondo pase al Fondo General de la Nación y que sea el Ministerio de Hacienda que determine qué buen uso le puede dar”,

El proyecto de decreto declara la disolución de CONMIGRANTES, organismo de derecho público, sin fines de lucro, que fue creado a través de la “Ley Especial para la Protección y Desarrollo de la Persona Migrante Salvadoreña y su Familia” que fue aprobada en 2011; la cual también será derogada.
Esta disolución se sumaría a otras siete instituciones que fueron disueltas a petición del gobierno, entre esas el Organismo Promotor de Exportaciones e Inversiones de El Salvador (PROESA) que fue sustituido por la Agencia de Promoción de Inversiones y Exportaciones de El Salvador (INVEST). Además, pidió la disolución del Instituto Salvadoreño de Formación Profesional (INSAFORP) y el Instituto Nacional de la Juventud (INJUVE) con la propuesta de “Ley del Sistema Nacional de Integración”, la cual aún no ha sido aprobada por la Asamblea Legislativa.
Cabe destacar que CONMIGRANTES está conformado por representantes gubernamentales y no gubernamentales, a través de asociaciones de salvadoreños en el exterior; por universidades y sector privado.
Será el Ministerio de Relaciones Exteriores, por medio del Viceministerio de Diáspora y Movilidad Humana el que sucederá en las funciones, atribuciones, competencias, responsabilidades y obligaciones al CONMIGRANTES.
“El plazo para la liquidación será de hasta 60 días calendario, contados a partir de la entrada en vigor del presente decreto”, dicta el proyecto de ley.
Y establece que el personal que desempeña funciones propias del Consejo y cuyas obligaciones “sean indispensables” para el funcionamiento de las responsabilidades que se trasladen conservarán su relación laboral con el Ministerio de Relaciones Exteriores para su “reubicación administrativa”.
Además, se facultará a ese Ministerio a nombrar una comisión liquidadora que emitirá los lineamientos para el proceso de liquidación de los activos y pasivos y el traslado de funciones al Ministerio.
La propuesta entró en la sesión plenaria de este martes con la firma de algunos diputados de Nuevas Ideas.
Doble funcionamiento
Para disolver la entidad, el oficialismo argumenta que en 2021 se creó el Viceministerio de Diáspora y Movilidad Humana dentro del Ministerio de Relaciones Exteriores, el cual tendría dentro de sus funciones la promoción y protección de los derechos humanos de la persona migrante.
“Es ahí donde vemos desde su creación en el 2021 donde se han desarrollado todas las funciones que en un momento dado pensaron crearse en CONMIGRANTES; pero realmente estas nunca se ejecutaron”, dijo Bran.
Agregó que CONMIGRANTES está adscrito al Ministerio de Relaciones Exteriores y sus actividades tienen que ver con el Viceministerio de Diáspora.
“Es ahí donde decimos para qué tener un fondo, con el que se alimenta CONMIGRANTES, y que no se está utilizando realmente; para qué tener a CONMIGRANTES creado cuando ya vimos que las funciones se están haciendo tal cual fueron creadas desde el momento que se creó el Viceministerio de Diáspora y Movilidad Humana, para qué duplicar esfuerzos”, expresó Bran.
Argumentó que el Viceministerio tiene más programas de trabajo y el Consejo “no tuvo efectividad”.
