The criminal reforms recently approved by the Legislative Assembly only seek to facilitate the conviction of individuals who have been massively captured as quickly as possible, thereby fulfilling the promise “that they will never leave the prisons,” said Father Andreu Oliva during the YSUCA interview on Friday.
“These are reforms that seek to solve a problem that the State now has, finding itself with more than 70,000 people deprived of freedom, and does not know how to judge them or how to carry out what the authorities have said, that they will never leave the prisons, that they will remain there all their lives,” Oliva expressed.
“All these reforms seek to allow the judge to easily convict the people brought to trial, with generic accusations, because none of the cases are individualized,” added Father Oliva.
The Central American University José Simeón Cañas (UCA) rector also showed his indignation because human rights violations are being committed by capturing people without any prior investigation or any legal basis supporting the arrests.
“We know that within the framework of the state of exception, massive captures have been made, many people for being at the time, in the place where the Police and the Army were making captures, but their relatives indicate that they are upright people, who live from honest work,” explained the Father.
Oliva argued that the fact that procedural guarantees are eliminated, the right to defense is denied, trials are conducted without individualizing, and generic charges of terrorism or illicit organizations are made without substantiating those allegations properly, allows serious injustices to be committed.
“It is a serious violation of the right to defense, legal security, and due process that every person must have before being convicted,” he assured.
On the other hand, the academic considers it regrettable that even police reports are intended to be used as evidence of having committed a crime. These things are not acceptable regarding the exercise of justice at the international level.
“It is very difficult and complex; people’s lives are being played with, starting from the assumption that what the police and the prosecutor’s office say will be correct,” he warned.
“I think that is regrettable because it is a loss for Salvadoran society of the rule of law, of legal security, of the great universal principle that everyone is innocent until proven otherwise,” Oliva added.
Lack of Independence from the Assembly
On the other hand, the rector of the UCA pointed to the lack of independence of the Legislative Assembly from the Executive Branch when approving these reforms.
“The Legislative Assembly and especially the New Ideas bench and its allies are at the service of fulfilling what comes to them from above,” he stated.
Oliva explained that although the Legislative Commission analyzed the reforms in this case, it did so quickly without modifying them and took them to the legislative plenary where they were approved without discussion.
“I think this is something we are seeing, not only in this case but in the normal way of acting by the Legislative Assembly, where everything that comes from the Executive is approved without further discussion or verification,” he said.
The Father believes it is important to analyze “whether the legislators truly fulfill their obligation to protect the rights of the Salvadoran population.”
Regarding the general population’s approval of Security policies, despite human rights violations, the Father reflects that Salvadoran society, on the one hand, favors these policies because it has been greatly affected by the activity of criminal groups.
“That suffering does not allow us to see things clearly. We have been freed from this suffering, but we do not see the consequences of the subsequent actions being taken,” he expressed.
Padre Oliva: “Se está jugando con la vida de las personas”
Las reformas penales aprobadas recientemente por la Asamblea Legislativa solo buscan facilitar la condena en el menor tiempo posible de las personas capturadas masivamente y de esa forma cumplir con la promesa “de que nunca van a salir de las prisiones”, señaló este viernes el padre Andreu Oliva durante la entrevista de la YSUCA.
“Son reformas que lo que buscan es resolver un problema, que ahora tiene el Estado que se encuentra con más de 70,000 personas privadas de libertad, y que no sabe cómo juzgarlas y cómo poder llevar a cabo lo que y han dicho las autoridades, que no van a salir nunca de de las prisiones, que van a permanecer ahí toda su vida”, expresó Oliva.
“Todas estas reformas buscan permitir que el juez fácilmente pueda condenar a las personas que se le lleven a juicio, con acusaciones genéricas, porque no se individualiza ninguno de los casos”, agregó el padre Oliva.
El rector de la Universidad Centroamericana José Simeón Cañas (UCA) además mostró su indignación debido a que se están cometiendo violaciones a los derechos humanos al capturar personas sin ninguna investigación previa y sin ningún fundamento jurídico que avale las detenciones.
“Sabemos que en el marco del régimen de excepción han hecho capturas masivas, muchas personas por estar en el momento, en el lugar en que la Policía y el Ejército estaban realizando capturas, pero sus familiares señalan que son personas cabales, que viven de un trabajo honesto”, explicó el Padre.
Oliva expuso que el hecho que se eliminen las garantías procesales, se niegue el derecho a la defensa, se hagan juicios sin individualizar y se acuse de delitos genéricos de terroristas o de organizaciones ilícitas sin sustentar esos señalamientos de la manera debida, permite que se cometan graves injusticias.
“Es una grave violación al derecho de defensa, la seguridad jurídica y al debido proceso que toda persona debe tener antes de ser condenada”, aseguró.
Por otra parte, el académico considera lamentable que se pretenda utilizar hasta las actas policiales como medio probatorio de haber cometido un delito, cosas que no son aceptables en cuanto al ejercicio de la justicia a nivel internacional.
“Es muy difícil y muy complejo, se está jugando con la vida de las personas, se está partiendo de que lo que diga la policía y la fiscalía va a ser lo correcto”, advirtió.
“Creo que eso es lamentable porque es una pérdida para la sociedad salvadoreña del Estado de derecho, de la seguridad jurídica, del gran principio universal de que toda persona es inocente mientras no se demuestra lo contrario”, agregó Oliva.
Falta de independencia de la Asamblea
Por otra parte, el rector de la UCA señaló la falta de independencia de la Asamblea Legislativa respecto al Órgano Ejecutivo al momento de aprobar estas reformas.
“ La Asamblea Legislativa y en especial la bancada de Nuevas Ideas y sus aliados, están al servicio de cumplir con lo que les viene señalado desde arriba”, manifestó.
Oliva expuso que a pesar que en este caso la Comisión Legislativa analizó la reformas, lo hizo de manera rápida sin modificarlas y la llevó al pleno legislativo donde fueron aprobadas sin discusión.
“Creo que es algo que estamos viendo, no solo en este caso, sino en la forma normal de actuar de la Asamblea Legislativa donde todo lo que viene del Ejecutivo se aprueba sin mayor discusión sin verificar”, dijo.
El padre considera que es importante analizar “si realmente los legisladores, están cumpliendo con la obligación que tienen de velar por los derechos de la población salvadoreña”.
En cuanto a la aprobación de la población en general de las políticas de Seguridad, a pesar de las violaciones de derechos humanos, el Padre reflexiona que la sociedad salvadoreña por un lado está a favor de estas políticas, porque ha vivido muy afectada por la actividad de los grupos criminales.
“Ese sufrimiento no nos permite ver las cosas con claridad. Nos han liberado de este sufrimiento, pero no vemos las consecuencias de las acciones posteriores que se están tomando”, expresó.
