The director of Humanitarian Legal Aid (SJH), Ingrid Escobar, stated this Thursday (07.27.2023) that organizations estimate that in El Salvador, there are more than 75,000 girls, boys, and adolescents affected by the exception regime, a measure in force since 2022 to combat gangs, and who are “abandoned by the State”.
“Unfortunately, the innocent detainees – who are no fewer than 20,000 – are not the only victims of the irresponsibility of the execution of the exception regime,” given that the SJH “has identified that there are more than 75,000 girls, boys, and adolescents in the state’s abandonment,” Escobar stated at a press conference.
She indicated that this data has been checked with other organizations and is about “children of people deprived of liberty” under the exception regime. “We can demonstrate that the children do not have access to basic services, such as quality health and education, or psychological attention,” added Escobar.
The SJH was founded on July 25, 2022, and since then, it has received more than 2,500 complaints, of which 1,376 are arbitrary detentions. According to its director, it also records information about some 300 people detained who would have died in state custody, of which they have confirmed 170.
The SJH has accompanied the presentation of 1,285 habeas corpus before the Constitutional Chamber of the Supreme Court of Justice for “people arbitrarily captured,” of which 1,260 have not been resolved, she added.
The Legislative Assembly, at the request of the government of Nayib Bukele, approved the exception regime in March 2022, which has left more than 71,770 people detained and whom the Executive accuses of being gang members, after an escalation of homicides attributed to the so-called maras.
Humanitarian organizations report 5,490 “direct victims” of abuses in the context of the exception measure.

La directora del Socorro Jurídico Humanitario (SJH), Ingrid Escobar, dijo este jueves (27.07.2023) que las organizaciones estiman que en El Salvador son más de 75.000 las niñas, niños y adolescentes afectados por el régimen de excepción, una medida vigente desde 2022 para combatir a las pandillas, y que están en “abandono por el Estado”.
“Lamentablemente, los inocentes detenidos -que no son menos de 20.000- no son las únicas víctimas de la irresponsabilidad de la ejecución del régimen de excepción”, dado que el SJH “ha identificado que hay más de 75.000 niñas, niños y adolescentes en abandono del Estado”, afirmó Escobar en una conferencia de prensa.
Indicó que este dato se ha cotejado con otras organizaciones y que trata de “hijos de personas privadas de libertad” bajo el régimen de excepción. “Podemos evidenciar que los niños no tienen acceso a servicios básicos, como salud y educación de calidad (ni) atención psicológica”, agregó Escobar.
El SJH se fundó el 25 de julio de 2022 y desde entonces ha recibido más de 2.500 denuncias, de las que 1.376 son detenciones arbitrarias. También, registra información de unas 300 personas detenidas que habrían fallecido en custodia estatal, y de las que han confirmado 170, según su directora.
El SJH ha acompañado la presentación de 1.285 habeas corpus ante la Sala de lo Constitucional de la Corte Suprema de Justicia de “personas capturadas de manera arbitraria”, de los que 1.260 no se han resuelto, añadió.

Las organizaciones humanitarias dan cuenta de 5.490 “víctimas directas” de atropellos en el contexto de la medida de excepción.
