The executive director of the Foundation for the Study of the Application of Law (Fespad), Henri Fino, categorized the suspension of 47 intern doctors following a peaceful protest in support of two colleagues as a clear example of the “criminalization of freedom of speech.”
“In the case of the young doctors who expressed solidarity, they were simply exercising their right to freedom of expression. They were expressing their solidarity with their colleagues,” the lawyer said in an interview on YSUCA radio.
The medical guild reported last weekend that their colleagues were dismissed from their positions for going out in front of the Rosales hospital to protest the sanctions applied to their colleagues Beatriz Monteagudo and Ángela Ferrer.
Both were removed from their duties on May 20th after making posts on social networks following a stampede that left several dead and injured at the Cuscatlán stadium.
In Fino’s opinion, “these young women were suspended for also expressing their thoughts.”
The lawyer also emphasized that the doctors’ protest did not constitute a total suspension of services in the hospital but rather a decrease in certain areas.
The Fespad representative stressed that all Salvadorans have the right to freely express what they are thinking; however, the response that the doctors received from the State was repression, for which “there is no justification.”
The medical guild warned it would increase pressure measures against sanctions on its members and violating due process. At that point, the Ministry of Labor agreed to establish a dialogue table.
This “dialogue table” is unnecessary for Fino, as the doctors have not failed in their obligations, and their rights have been violated.
“Criminalization of protest”
“Unfortunately, in recent months, there has been a criminalization of protest. If not, let’s see what has happened in Soyapango, San Marcos, among others,” he added, citing examples where unionists have been sanctioned and even arrested for expressing their disagreement.
“What is happening in these times in El Salvador, there is a tremendous fear of the expression of the population, the government fears that the people express themselves, the government limits the freedom of the population to surveys (…) those are the ones that the government likes if they give it popularity,” said Fino.
At this point, the lawyer reminded the government that people have the right to express themselves. The State must guarantee these freedoms, including marches, which it has tried to block with threats, checkpoints, and even the detention of participants.
“The government and the president have no interest in listening to the population,” added Fino.
As a result of these actions, the Fespad representative emphasized that “we are not in a state of law; we are in a dictatorship where nobody can express what they think or feel freely.”
Fino noted that it has become more common in recent months to affirm that the regime will be applied to anyone who is not in favor of the government’s directives.
“This regime of exception, besides having ceased to be exceptional, has become a tool of repression in our country,” denounced Fino, stressing that “this can only be called a dictatorship.”

Abogado Henri Fino: Represión a médicos confirma que “estamos en una dictadura”
De un claro ejemplo de “criminalización de la libertad de expresión” calificó el director ejecutivo de la Fundación de Estudios para la Aplicación del Derecho (Fespad), Henri Fino, la suspensión de 47 médicos internos tras manifestarse pacíficamente en apoyo a dos colegas.
“En el caso de los jóvenes médicos que se expresaron en solidaridad, sencillamente ellos estaban haciendo uso del derecho a la libertad de expresión. Ellos estaban expresando su solidaridad con sus compañeras”, declaró el abogado al ser entrevistado en la radio YSUCA.
El gremio médico denunció el fin de semana que sus colegas fueron separados de sus cargos por salir al frente del hospital Rosales a pronunciarse por las sanciones aplicadas a sus compañeras Beatriz Monteagudo y Ángela Ferrer.
Ambas fueron separadas de sus labores el 20 de mayo luego de hacer publicaciones en redes sociales tras la estampida que dejó varios muertos y heridos en el estadio Cuscatlán.
A juicio de Fino, “estas jóvenes fueron suspendidas por expresar también su pensamiento”.
El abogado también subrayó que la protesta de los médicos no constituyó una suspensión total de los servicios en el hospital, sino una disminución en ciertas áreas.
El representante de Fespad recalcó que todos los salvadoreños tienen derecho a expresar de forma libre que están pensando; sin embargo, la respuesta que los médicos recibieron por parte del Estado fue la represión, para lo que “no hay ninguna justificación”.
El gremio médico advirtió que incrementaría las medidas de presión contra las sanciones a sus miembros y la violación del debido proceso, ante lo cual el Ministerio de Trabajo accedió a establecer una mesa de diálogo.
Para Fino, no es necesaria esa “mesa de diálogo”, pues los médicos no han incumplido con sus obligaciones y se les ha violentado su derecho.
“Criminalización de la protesta”
“Lamentablemente en los últimos meses ha habido una criminalización de la protesta. Si no, veamos lo que ha sucedido en Soyapango, San Marcos, entre otros”, agregó, citando ejemplos en los que se ha sancionado y hasta capturado a sindicalistas por expresar su inconformidad.
“Qué es lo que sucede en estos tiempos en El Salvador, hay un tremendo temor a la expresión de la población, el gobierno teme a que el pueblo se exprese, el gobierno limita la libertad de la población a las encuestas (…) esas son las que le gusta al gobierno si le dan popularidad”, dijo Fino.
En este punto, el abogado le recordó al gobierno que las personas tienen derecho a expresarse y el Estado debe garantizar esas libertades, incluidas las marchas, a las cuales ha tratado de bloquear con amenazas, retenes y hasta la detención de participantes.
“El gobierno y el presidente no tiene interés de escuchar a la población”, agregó Fino.
A raíz de estas acciones el representante de Fespad recalcó que “no estamos en un estado de derecho, estamos en una dictadura donde nadie puede expresar lo que piensa o siente libremente”.
Fino señaló que en los últimos meses se ha vuelto más común afirmar que se les va a aplicar el régimen a cualquier persona que no esté a favor de las directrices del gobierno en turno.
“Este régimen de excepción, además de haber dejado de ser excepcional, se ha convertido en una herramienta de represión en nuestro país”, denunció Fino, recalcando que “esto no se puede llamar más que una dictadura”.
