With 67 votes in favor, six against, and seven abstentions, the deputies of the Legislative Assembly approved the 14th extension to the exception regime in El Salvador after it was requested in the afternoon of Tuesday 16 by the Salvadoran Government’s Security Cabinet.

In response, the suspension of legal guarantees will remain in effect for 30 more days. The measure has been in place since March 2022 to combat gangs after multiple murders occurred on the weekend.

The regime, which initially would have a duration of 30 days while the Government controlled a wave of homicides, has become a permanent measure and today marks 416 days, during which at least three constitutional rights of Salvadorans have been suspended.

The Minister of Justice and Public Security, Gustavo Villatoro, delivered the initiative to the president of the Legislative Assembly, Ernesto Castro, who emphasized that this extension will be approved every time the Government requests it.

“This is the security cabinet of President Nayib Bukele; it is an innovative, forceful strategy for the good of all majorities; that is the democracy that President Nayib Bukele wants to have, where the governments, the state organs listen to the demands of the population and solve them,” Villatoro assured when delivering the request.

Unlike other times, this time, the Security Cabinet did not provide figures of people arrested and processed by the judicial system under the exception regime. Instead, the officials highlighted the reduction in homicides and attacked the critics of the exception regime.

During his speech, the Minister of Security lashed out against international organizations, whom he accused of being “in love with human rights and criminals,” of “sponsoring” gang members, and of conspiring against the government of Nayib Bukele. “Overthrowing the power of the people will no longer be easy for these international organizations,” he said.

The Inter-American Commission on Human Rights (IACHR), the United Nations (UN), and numerous organizations have pointed out human rights violations during the implementation of the exception regime, including threats, tortures, and even executions within prisons, as well as arbitrary arrests.

Of the total of 68,720 detainees, almost 5,000 have been released, as confirmed by the same head of Security in an interview this morning. This means that at least 7% of the detainees are not linked to gangs.

A Permanent Regime

In addition to his attacks on human rights defense organizations, Villatoro also issued a warning to opponents: he stated that they have committed not to “return to a bipartisan dictatorship,” referring to the governments of ARENA (1999-2011) and FMLN (2012-2019).

“We are not going to return to this bipartisan dictatorship, and as the Executive Branch hand in hand with the Legislative Branch and the Judicial Branch, know that we will make sure that these members are no longer a problem for our children, for our children’s children, or our children’s children’s children,” he asserted.

These statements are added to the positions of opposition members, who point out the political and electoral use of the exception regime to intimidate government contenders.

According to the Minister of National Defense, Francis Merino Monroy, he stated that “the exception regime is applied solely and exclusively to criminals.”

Aprueban 14° prórroga al régimen de excepción en El Salvador

Con 67 votos a favor, seis en contra y siete abstenciones, los diputados de la Asamblea Legislativa aprobaron la 14° prórroga al régimen de excepción en El Salvador, luego de que fuera solicitada en horas de la tarde del martes 16 por el Gabinete de Seguridad del Gobierno salvadoreño.

Ante esto, la suspensión de garantías jurídicas se mantendrá vigente por 30 días más. La medida fue puesta en marcha desde marzo de 2022 para combatir a las pandillas tras múltiples asesinatos ocurridos en un solo fin de semana.

El régimen, que originalmente tendría una vigencia de 30 días mientras el Gobierno controlaba una ola de homicidios, se ha vuelto una medida permanente y cumple hoy 416 días, en los que han estado suspendidos al menos tres derechos constitucionales de los salvadoreños.

La iniciativa fue entregada por el ministro de Justicia y Seguridad Pública, Gustavo Villatoro, al presidente de la Asamblea Legislativa, Ernesto Castro, quien recalcó que se aprobará esta prórroga cada vez que el Gobierno la solicite.

“Este es el gabinete de seguridad del presidente Nayib Bukele, es una estrategia innovadora, contundente y para bien de todas las mayorías, esa es la democracia que quiere tener el presidente Nayib Bukele, donde los gobiernos, los órganos de Estado escuchan las demandas de la población y las solucionan”, aseguró Villatoro, al entregar la solicitud.

A diferencia de otras ocasiones, esta vez, el gabinete de Seguridad no brindó cifras de personas capturadas y procesadas por el sistema judicial en el marco del régimen de excepción. En su lugar, los funcionarios destacaron la reducción de homicidios y atacaron a los críticos del régimen de excepción.

Durante su discurso, el ministro de Seguridad arremetió en contra de los organismos internacionales, a quienes acusó de estar “enamorados de los derechos humanos y de los criminales”, de “auspiciar” a los pandilleros y de conspirar contra el gobierno de Nayib Bukele. “Derrocar al poder del pueblo a estos organismos internacionales ya no les será fácil”, dijo.

La Comisión Interamericana de Derechos Humanos (CIDH), la Organización de las Naciones Unidas (ONU) y numerosos organismos han señalado violaciones a derechos humanos durante la implementación del régimen de excepción, incluyendo amenazas, torturas y hasta ejecuciones al interior de las cárceles; así como capturas arbitrarias.

Del total de 68,720 detenidos casi 5,000 han sido puestos en libertad, según confirmó el mismo titular de Seguridad en una entrevista esta mañana. Esto significa que al menos un 7 % de los detenidos no tienen vínculos con pandillas.

Un régimen permanente

Además de sus ataques a organismos defensores de derechos humanos, Villatoro también lanzó una advertencia para opositores: afirmó que han asumido un compromiso para “no regresar a una dictadura bipartidista”, en referencia a los gobiernos de ARENA (1999-2011) y FMLN (2012-2019).

“A esta dictadura bipartidista ya no vamos a regresar, y como Órgano Ejecutivo de la mano con el Órgano Legislativo y el Órgano Judicial, sepan que nos vamos a encargar que estos miembros ya no sean un problema ni para nuestros hijos, ni para los hijos de nuestros hijos ni para los hijos de nuestros hijos de nuestros hijos”, afirmó.

A estas afirmaciones se suman las posturas de miembros de la oposición, que señalan un uso político y electoral del régimen de excepción para intimidar a contendientes del Gobierno.

Según el ministro de Defensa Nacional, Francis Merino Monroy, afirmó por su parte que “el régimen de excepción es aplicado única y exclusivamente a los delincuentes”.
