Former magistrates Sidney Blanco and Rodolfo González, who were part of the notable Constitutional Chamber known as “The Magnificent” (2009-2018), questioned the abuses committed under the state of exception and doubted that authentic judges are judging the cases of thousands of detainees.
On the YSUCA radio’s Legal Window program, the jurists said there is also no certainty that judges have the academic and professional profiles and competence to do so.
For former magistrate Blanco, there is no guarantee that those issuing rulings in judicial proceedings are indeed judges, as their names are not made public in the sentences, their fellow judges do not know who is exercising, and the Supreme Court keeps their resumes or life stories in reserve or secret.
“It is not known if it is a judge who is issuing a resolution or who it will be,” Blanco questioned.
The former magistrate explained that the issue of faceless judges, where the identity of the judge and the prosecutor is reserved, does not allow the defendants, for certain crimes, to know whom the judge judging them is nor whom the prosecutor is accusing them of. Therefore, “they cannot challenge (object to) the judge.”
The provision to omit the identity of the judges has been in force since March 2022, when the reform to article 73-A of the Criminal Procedure Code was quickly approved and published the same day in the Official Gazette. The measure was approved days before the State of Exception came into effect.
The reform was promoted by the Presidency of the Republic and not by the Supreme Court of Justice.
“I have had the opportunity to see minutes where the name of the judge who has pronounced the resolution is omitted. This is a mystery; it is not known who the judges are, especially the specialized judges, and even their fellow judges do not know who these people are, nor how they have been appointed, because the Supreme Court of Justice has kept the resumes of the new judges and also the information of how these people arrived in reserve (secret),” Blanco pointed out.

Los exmagistrados Sidney Blanco y Rodolfo González, quienes integraron la destacada Sala de lo Constitucional conocida como “Los Magníficos” (2009-2018), cuestionaron los abusos cometidos bajo el régimen de excepción y pusieron en duda que auténticos jueces estén juzgando los casos de millares de capturados.
En el programa Ventana Jurídica de la radio YSUCA, los juristas dijeron que no hay certeza tampoco de que quienes fungen como jueces tengan los perfiles académicos y profesionales y competencia para serlo.
Para el exmagistrado Blanco, no hay garantía que quienes estén emitiendo resoluciones en los procesos judiciales sean verdaderamente jueces, debido a que el nombre de ellos no se hace público en las sentencias, sus colegas jueces no conocen a quienes estén ejerciendo y la Corte Suprema mantiene en reserva o secreto sus hojas de vida.
“No se sabe si es un juez el que está dictando una resolución o quién será”, cuestionó Blanco.
El exmagistrado explicó que el tema de los jueces sin rostro, en donde hay una reserva de la identidad del juez y del fiscal, no permite a los acusados, por ciertos delitos, conocer quién es el juez que les está juzgando, ni quién es el fiscal que le está acusando, y por lo tanto, “no pueden recusar (objetar) al juez”.
La disposición de omitir la identidad de los jueces se mantiene vigente desde marzo de 2022, cuando se aprobó de manera exprés la reforma al artículo 73-A del Código Procesal Penal y se publicó el mismo día en el Diario Oficial. La medida fue aprobada a días de la entrada en vigencia del Régimen de Excepción.
La reforma fue promovida por la Presidencia de la República y no por la Corte Suprema de Justicia.
“He tenido la oportunidad de ver actas en donde se omite el nombre del juez que ha pronunciado la resolución. Esto es un misterio, no se sabe quiénes son los jueces, sobre todos los jueces especializados, que ni los propios colegas jueces conocen quiénes son estas personas, ni cómo han sido nombrados, porque la Corte Suprema de Justicia ha puesto en reserva (secreto) las hojas de vida de los nuevos jueces y también la información de cómo llegaron estas personas”, señaló Blanco.
