Relatives of the ex-mayor of San Salvador, Ernesto Muyshondt, confirmed to PRENSA GRÁFICA that his health situation is delicate and that he has taken the decision, three weeks ago, to go on hunger strike after being in prison for almost 20 months.
“For three weeks, he has been on hunger strike; his condition is by the people who make that decision,” said a relative of the ex-official, who faces at least three judicial processes.
“I hope it does not result in a health crisis; after almost 20 months of being deprived of freedom, his state of mind and health have deteriorated”, he added.
In response to rumors circulating in social networks about the alleged death of the former mayor, family members denied this information and clarified that Muyshondt was in prison. The Eighth Court of Instruction of San Salvador has scheduled tomorrow’s preliminary hearing against the former official.
Judicial sources have warned that the former official will not be transferred to the Judicial Center and that he will face the hearing virtually. However, relatives doubt that the proceeding will take place, but it will depend on the judge if he does it.
This hearing will be for the crime of misappropriation of tax withholdings or perceptions to the detriment of the public treasury. Muyshondt is accused of misuse after the Ministry of Finance conducted an audit of the Municipal Directorate for Solid Waste of the Municipality of San Salvador and established that this division had withheld income in the amount of $275,145 when he was mayor.
On June 6, 2022, the same court denied house arrest in favor of the former official after a special hearing to review the measures. Muyshondt’s defense for health reasons requested the proceeding. On that occasion, he said that he had been on the verge of death at least three times.
Upon leaving the hearing, the former mayor blamed the Court and the promoters of the accusation against him for what happened to him after he was denied release with alternative measures.
Muyshondt also assured at that time that the configuration of the crime for which he is still provisionally detained no longer exists since the mayor’s office canceled the debt for which he is accused. “It is of public knowledge that the mayor’s office finally paid what we were prevented from paying with the blockades we received. Other arguments merit that after 12 long months of being unjustly imprisoned, he can at least have house arrest”, he pointed out.
Ernesto Muyshondt en huelga de hambre desde hace tres semanas
Familiares del exalcalde de San Salvador, Ernesto Muyshondt, confirmaron a la PRENSA GRÁFICA, que la situación de salud se encuentra delicada y que ha tomado la decisión, desde hace tres semanas, de estar en huelga de hambre luego de permanecer por casi 20 meses en prisión.
“Desde hace tres semanas se encuentra en huelga de hambre, su estado es acorde a las personas que toman esa decisión”, dijo un pariente del exfuncionario, quien enfrenta al menos tres procesos judiciales.
“Espero que no se desenlace en una crisis de salud, después de casi 20 meses de estar privado de libertad, tanto su estado anímico como de salud se ha deteriorado”, agregó.
Ante los rumores que circularon en redes sociales sobre el supuesto fallecimiento del exalcalde, familiares desmintieron esa información y aclararon que Muyshondt se encuentra en prisión. El Juzgado Octavo de Instrucción de San Salvador ha programado para mañana la audiencia preliminar en contra del exfuncionario.
Fuentes judiciales han advertido que el exfuncionario no será trasladado al Centro Judicial y que enfrentará la audiencia de forma virtual. Sin embargo, familiares dudan que la diligencia se lleve a cabo pero que dependerá del juez si la realiza.
Esta audiencia será por el delito de apropiación indebida de retenciones o percepciones tributarias en perjuicio de la hacienda pública. Muyshondt es señalado de apropiación luego que el Ministerio de Hacienda realizó una fiscalización a la Dirección Municipal para los Desechos Sólidos de la Alcaldía de San Salvador y estableció que esta división había retenido renta por un monto de $275,145 cuando él era alcalde.
El 6 de junio de 2022 el mismo juzgado negó el arresto domiciliario a favor del exfuncionario, luego de una audiencia especial de revisión de medidas. La diligencia fue solicitada por la defensa de Muyshondt por motivos de salud. En esa ocasión, él dijo en esa ocasión que había estado al menos tres veces al borde de la muerte.
Al salir de la audiencia, el exalcalde responsabilizó al Juzgado y a los promotores de la acusación en su contra de lo que le ocurriera luego de negarle la libertad con medidas alternas.
Muyshondt aseguró también en ese momento que la configuración del delito por el que sigue detenido provisionalmente ya no existe, ya que la alcaldía canceló la deuda por la que lo acusan. “Es de conocimiento público que la alcaldía finalmente pagó lo que se nos imposibilitó pagar con los bloqueos que recibimos y hay otros argumentos que ameritan que después de 12 largos meses de estar injustamente encarcelado pueda tener al menos el arresto domiciliar”, señaló.
