The Integral Pension Law presented by the government was approved yesterday in the Assembly with 67 votes in favor; one of the votes was from ARENA deputy René Portillo Cuadra; 12 abstentions and two against, from the FMLN, ARENA, Nuestro Tiempo, and VAMOS parties.
Deputies of Nuevas Ideas assure that the 2017 pension reforms were a “poisoned candy”; however, with the new pension law, although it reflects an increase in the minimum old age pension from $304 to $400, it leaves the way free for the government to take workers’ savings without any limit.
This is detailed in literal i) of Art. 82 of the law establishes that the Pension Fund will have no limits to acquiring Pension Obligation Certificates (COP) from the Salvadoran Pension Institute, created just yesterday by the parliamentarians.
Even it will not be necessary to have a risk rating. They assure that these COPs will be used for self-sustainability of the ISSS and INPEP pension payments.
The opposition deputies of the FMLN, VAMOS, and Nuestro Tiempo, questioned that the proposal presented by the Minister of Finance, Alejandro Zelaya, was already made, “designed behind closed doors” and annuls the right of workers to withdraw up to 25% of their pension savings.
Congresswoman Claudia Ortiz of VAMOS alleged that the meetings where the bill was discussed were held behind closed doors; this was because of what Suecy Callejas of Nuevas Ideas said, that they could not take into account the recommendations of the unions because the actuarial studies they had already made before submitting the bill for consultation were destroyed.
The new law increases the minimum pension by almost $100. Still, on the other hand, it punishes those contributors who chose to withdraw 25% of their savings early, thus annulling the opportunity to access the 30% increase on the calculation of their pension at the time of retirement, as proposed by the new reform.
The Congresswoman made a further remark: in the draft of the National Budget Law for 2023, the minimum pension is not reflected in $400 but in $304, as it is in the current law.
He also spoke about the proposed 30% increase in pensions in the new law. According to him, the most benefited will not be those who earn the least. Still, those with higher salaries, such as a pension of $304, will only be able to access an increase of $400. In contrast, someone whose pension calculation is $1,000 will be able to increase their pension by up to $300 with the application of the 30% adjustment.

La ley Integral de Pensiones presentada por el gobierno fue aprobada ayer en la Asamblea con 67 votos a favor; uno de los votos fue del diputado de ARENA, René Portillo Cuadra; 12 abstenciones y 2 en contra, de los partidos FMLN, ARENA, Nuestro Tiempo y VAMOS.
Diputados de Nuevas Ideas aseguran que las reformas de pensiones de 2017 fueron un “dulce envenenado”; sin embargo, con la nueva ley previsional, si bien refleja un aumento de la pensión mínima por vejez de $304 a $400, deja libre el camino al gobierno para tomarse los ahorros de los trabajadores sin ningún límite.
Lo anterior está detallado en el literal i) del Art. 82 de la ley que establece que el Fondo de Pensiones no tendrá límites para adquirir Certificados de Obligación Previsionales (COP) al Instituto Salvadoreño de Pensiones, creado ayer mismo por los parlamentarios.
Incluso, no será necesaria la calificación de riesgo. Aseguran que estos COP servirán para la autosostenibilidad del pago de pensiones del ISSS y del INPEP.
Los diputados de la oposición del FMLN, VAMOS y Nuestro Tiempo, cuestionaron que la propuesta que llevó el ministro de Hacienda, Alejandro Zelaya, ya estaba hecha, “diseñada a puerta cerrada” y anula el derecho que tenían los trabajadores de poder retirar hasta el 25% de sus ahorros para pensionarse.
La diputada Claudia Ortiz, de VAMOS, alegó que las reuniones en donde de verdad se discutió el proyecto de ley se hicieron a puerta cerrada, esto a raíz de lo que dijo Suecy Callejas, de Nuevas Ideas, de que no podían tomar en cuenta las recomendaciones de los sindicatos, porque se desbarataban los estudios actuariales que ya habían realizado antes de someter el proyecto a consulta.
La nueva ley incrementa la pensión mínima en casi $100, pero por otro lado, castiga a los cotizantes que optaron por retirar anticipadamente el 25% de sus ahorros, anulándoles la oportunidad de acceder al incremento del 30% sobre el cálculo de su pensión a la hora de jubilarse, que plantea la nueva reforma.
La diputada efemelenista hizo otra acotación más, y es que en el proyecto de Ley del Presupuesto de la Nación para 2023 la pensión mínima no está reflejada en $400 sino en $304, tal como está en la ley vigente.
De igual forma habló sobre el incremento del 30% a las pensiones que plantea la nueva ley. Según dijo, en realidad los más beneficiados no serán los que menos ganan, sino los que tienen salarios más altos, por ejemplo, quien tenga de pensión $304 solo podrá acceder a un aumento de $400, en cambio alguien cuyo cálculo de pensión sea de $1,000 podrá tener un alza en su pensión de hasta $300, con la aplicación del ajuste del 30%.
