In the context of the emergency regime, the lack of response to habeas corpus by the Constitutional Chamber responds to “political decisions” and complements the “security policy implemented by the State, ” said analysts and constitutional lawyers consulted by LA PRENSA GRÁFICA.
They also pointed out that the Chamber is taking refuge in the extended terms of the regime and therefore is not fulfilling its role.
For Wilson Sandoval, coordinator of the Office of Legal Counsel and Anti-Corruption of El Salvador (ALAC), habeas corpus is a request for relief. If they are processed, it is because there is urgency, but the current Chamber does not give them a priority because “it responds to other interests.”
“It seems that the Supreme Court of Justice has decided to take a role that complements the State’s public security policy. In this case, this role of complementing implies complying with one of the points that the Police, the Armed Forces, have expressed, and the Executive, which is that first arrest and then ask questions,” he said.
He also said that the current Constitutional Chamber has a more political than juridical role and is unconstitutional because they omit its actions. “It is very different from the previous Chamber, where in a matter of hours, habeas corpus were resolved in favor of people who had been violated during the pandemic (of covid-19, in 2020),” he stressed.

La falta de respuesta a los habeas corpus por parte de la Sala de lo Constitucional, en el contexto del régimen de excepción, responde a “decisiones políticas” y complementa la “política de seguridad implementada por el Estado”, aseguraron analistas y abogados constitucionalistas consultados por LA PRENSA GRÁFICA.
Señalaron también que la Sala se ampara en los plazos extendidos del régimen y que por ello no está cumpliendo su rol.
Para Wilson Sandoval, coordinador de la Oficina de Asesoría Legal y AntiCorrupción de El Salvador (ALAC), los habeas corpus son una solicitud de auxilio y si se tramitan es porque hay urgencia, pero la actual Sala no les da prioridad porque “responde a otros intereses”.
“Me parece que la Corte Suprema de Justicia ha decidido tomar un rol que complementa la política de seguridad pública del Estado. En este caso ese rol de complementar implica plegarse o ceñirse a uno de los puntos que se ha expresado de parte de la Policía, Fuerza Armada, del Ejecutivo y es que primero se arresta y después se pregunta”, aseguró.
Dijo además que la actual Sala de lo Constitucional tiene un rol más político que jurídico y también inconstitucional, porque omiten sus actuaciones. “Es algo muy diferente a la anterior Sala, donde en cuestión de horas se resolvían habeas corpus a favor de personas que habían sido violentadas durante la pandemia (del covid-19, en 2020)”, subrayó.
