The appointments of 19 administrative chiefs of the Judicial Branch made in the Full Court session of February 8, 2022, are not legal because the process indicated by law was not followed for them, according to an analysis made by the Anticorruption Legal Advisory Center (ALAC).

As LA PRENSA GRÁFICA published, in the session of February 8, a group of magistrates imposed by the Legislative Assembly on May 1, 2021, and aligned with the ruling party decided to subtract powers from the president of the Supreme Court of Justice (CSJ), Óscar López Jerez, and decided to appoint 17 administrative chiefs without his participation.

This “coup” to the presidency of the Judicial Branch was also studied by ALAC, which after a legal analysis of the situation, determined that “The criteria used by the Plenary for the election of these positions were not based on academic or professional merits as such” and therefore did not legally comply with what was required.

ALAC determined that the 11 magistrates who voted in favor of the appointments violated articles of the Constitution of the Republic, the Judicial Career Law, and internal regulations of the CSJ, including in this last section, the Manual of Classification of Positions of the Judicial Branch.

Nombramientos de jefaturas en la Corte Suprema fueron ilegales, dice ALAC

Los nombramientos de 19 jefaturas administrativas del Órgano Judicial realizadas en la sesión de Corte Plena del 8 de febrero de 2022 no son legales porque no se siguió para ellos el proceso que indica la ley, según un análisis realizado por el Centro de Asesoría Legal Anticorrupción (ALAC).

Tal como LA PRENSA GRÁFICA publicó, en la sesión del 8 de febrero un grupo de magistrados impuestos por la Asamblea Legislativa el 1 de mayo de 2021 y afines al oficialismo decidieron restarle atribuciones al presidente de la Corte Suprema de Justicia (CSJ), Óscar López Jerez, y decidieron nombrar a 17 jefes administrativos sin la participación de él.

Ese “golpe” a la presidencia del Órgano Judicial fue estudiado también por ALAC, quien tras un análisis jurídico de la situación determinó que “Los criterios utilizados por el Pleno para la elección de estos cargos no se basaron en méritos académicos o profesionales propiamente dichos” y que por lo tanto no cumplían legalmente con lo requerido.

ALAC determinó que para realizar los nombramientos de jefaturas los 11 magistrados que votaron a favor violentaron artículos de la Constitución de la República, la Ley de la Carrera Judicial y normativa interna de la CSJ, incluyendo en este último apartado el Manual de Clasificación de Cargos del Órgano Judicial.
