The number of habeas corpus filed before the Supreme Court of Justice (CSJ) has been increasing since the beginning of the emergency regime, last March 27, but without positive answers for the relatives of those captured who are located in the different prisons of the country.
The last monitoring carried out by the Anti-Corruption Legal Advice Center of El Salvador (ALAC) showed that between July 27 and August 28, 496 habeas corpus were presented, of which 89%, which is 442, were not resolved.
The CSJ data reveals that in the first five months of the emergency regime, 1,825 people approached the institution to request habeas corpus, primarily for arbitrary detentions committed by police and soldiers.
Requests for assistance have increased as the extensions of the regime have progressed. In the first month, the CSJ received 117 submissions, while for the fourth extension, corresponding to the fifth month, they increased to 496.
The highest number of requests was reported between June 27 and July 27, when 679 families decided to file an appeal with the Court.
Regarding the last period analyzed, most of the cases were reported before the Secretariat of the Constitutional Chamber, which received 416 requests. The magistrates imposed in that chamber did not resolve any of them.
Those who have appealed to lower courts have had better luck, as they have responded more significantly.
The president of the CSJ, Óscar López Jerez, was consulted as to why they did not resolve any request during this period, but he did not respond to the questions asked by this media.
Wilson Sandoval, the coordinator of ALAC, considered that the fact that the Chamber does not resolve any habeas corpus is a pattern that repeats itself and “can be interpreted as the Chamber assuming a role within the public security policy of the Executive. Not resolving urgently agrees with the scheme of ‘not letting anyone out, even if they have been arbitrarily detained”.
Representatives of the Movement of Victims of the Regime (MOVIR) also pointed out that the CSJ continues to respond to the interests of the Executive.
“The victims, in desperation to free their innocent loved ones, are occupying all resources. However, there is no will on the part of the state in any action taken. There is no favorable response to the victims with the habeas corpus because the Court also responds to the interests of the Executive, ” said Samuel Ramirez, representative of MOVIR.
Corte Suprema de Justicia sin resolver otros 442 habeas corpus vinculados a régimen de excepción
La cantidad de habeas corpus presentados ante la Corte Suprema de Justicia (CSJ) ha ido en aumento desde que inició el régimen de excepción, el pasado 27 de marzo, pero sin respuestas positivas para los familiares de los capturados que no son localizados en las distintas cárceles del país.
El último monitoreo realizado por el Centro de Asesoría Legal Anti Corrupción de El Salvador (ALAC) reflejó que entre el 27 de julio y el 28 de agosto se presentaron 496 habeas corpus, de los cuales el 89 %, es decir 442, no fueron resueltos.
Los datos de la CSJ revelan que en los primeros cinco meses del régimen de excepción 1,825 personas se abocaron a la institución para solicitar un habeas, en su mayoría por detenciones arbitrarias cometidas por policías y soldados.
Las peticiones de ayuda se han incrementado conforme avanzan las prórrogas del régimen. El primer mes la CSJ recibió 117 solicitudes, mientras que para la cuarta prórroga, correspondiente al quinto mes, aumentaron a 496.
La cifra más alta con respecto a solicitudes se reportó entre el 27 de junio y el 27 de julio, cuando 679 familias decidieron interponer ese recurso ante la Corte.
Sobre el último periodo analizado, la mayor parte de los casos se reportó ante la Secretaría de la Sala de lo Constitucional, a la que llegaron 416 solicitudes. Los magistrados impuestos en esa sala no resolvieron ninguno.
Mejor suerte han tenido las personas que han recurrido a juzgados de menor jerarquía, pues han dado respuesta en mayor proporción.
Se consultó al presidente de la CSJ, Óscar López Jerez, sobre el motivo por el que no resolvieron ninguna solicitud en ese lapso, pero no respondió a las preguntas realizadas por este medio.
Wilson Sandoval, coordinador de ALAC, consideró que el hecho que la Sala no resuelva ningún habeas corpus es un patrón que se repite y el cual “puede interpretarse como que la Sala asume un rol dentro de la política de seguridad pública del Ejecutivo. No resolver urgentemente concuerda con el esquema de ‘no dejar salir a nadie’, aunque haya sido detenido arbitrariamente “.
Representantes del Movimiento de Víctimas del Régimen (MOVIR) señalaron también que la CSJ sigue respondiendo a intereses del Ejecutivo.
“Las víctimas en su desesperación por liberar a sus seres queridos inocentes están ocupando todos los recursos. Sin embargo, en ninguna gestión que se hace existe voluntad de parte del estado. Con los habeas corpus no hay respuesta favorable a las víctimas porque la Corte también responde a los intereses del Ejecutivo”, dijo Samuel Ramírez representante del MOVIR.
