This Wednesday, the Legislative Assembly approved 65 votes in favor of a list of reforms to the Criminal Procedural Code. The objective of these modifications is to be able to prosecute some 81,000 fugitives from justice, informed the Minister of Security, Gustavo Villatoro, and the Attorney General, Rodolfo Delgado.
“Since 1998, there have been approximately 81,000 people who have been declared rebels in the courts”, said Villatoro, who added that they seek “that the criminal process is no longer a synonym of impunity or that the judge is not obliged to resolve a conflict due to the absence of a defendant.”
The reforms approved by the plenary this Wednesday, September 21, contemplate a revision of the process to declare a person in absentia, that is to say, that they have not presented themself for the operation against them.
The legislators also regulated the issue related to the resignation of defense attorneys in the middle of the criminal proceedings to avoid the cases being delayed and that people extinguish the period of 24 months without a firm conviction.
The minister criticized that to delay the process; another defense attorney was appointed in the middle of the process, which had already been previously selected. This second lawyer also resigned to ensure that the State would not do justice. Still, during the months, the lawyers were also in charge of transferring the names and addresses of witnesses and victims to ensure that Salvadorans who had been victims would never come to testify in court, Villatoro added.
The reforms also eliminated the accused’s power to intervene in the different stages of the process personally. This is so that criminal proceedings are not suspended due to the absence of the accused.

Este miércoles, la Asamblea Legislativa aprobó con 65 votos a favor un pliego de reformas al Código Procesal Penal. El objetivo de estas modificaciones es poder enjuiciar a unos 81,000 prófugos de la justicia, informaron el ministro de Seguridad, Gustavo Villatoro y el fiscal general, Rodolfo Delgado.
“Desde 1998 han existido aproximadamente 81,000 personas que han sido declaradas rebeldes en los tribunales”, afirmó Villatoro, quien agregó que buscan “que ya no sea el proceso penal un sinónimo de impunidad o que se obligue a que el juez no resuelva un conflicto por la ausencia de un imputado”.
Las reformas aprobadas por el pleno este miércoles 21 de septiembre contemplan una revisión del proceso para declarar a una persona en rebeldía, es decir que no se ha presentado al proceso en su contra.
Los legisladores también regularon lo relativo a las renuncias de abogados defensores a la mitad de los procesos penales, a fin de evitar que los casos se dilaten y que las personas extingan el periodo de 24 meses sin una condena firme.
El ministro criticó que para dilatar los procesos, se nombraba a la mitad del camino a otro defensor que ya estaba previamente seleccionado. Ese segundo abogado también renunciaba para lograr que el Estado no hiciera justicia, pero en ese lapso de meses que pasaban, también los abogados se encargaban de trasladar los nombres y las direcciones de los testigos y de las víctimas, para garantizarse que los salvadoreños que habían sido víctimas no llegaran nunca a declarar a las sedes judiciales, agregó Villatoro.
Las reformas también eliminaron la facultad de los imputados de intervenir personalmente en las diferentes etapas del proceso. Esto con el objetivo de que no se suspendan las diligencias penales por la falta del imputado.
