The Armed Forces of El Salvador (FAES) will not be obliged by law to open the war archives and will be exempted from executing reparation projects in favor of the victims of the armed conflict, but will be part of the National Council that will articulate and coordinate the execution of the same in all the institutions of the State.
This will be established if the Special Law of Transitional Justice for Victims of Human Rights Violations in the context of the Salvadoran armed conflict is approved, a bill that the government of Nayib Bukele has drafted and of which LA PRENSA GRÁFICA has a copy.
The Vice-Presidency of the Republic has drafted the proposal, headed by Felix Ulloa. It consists of 81 articles, among which reparation, restitution, compensation, and rehabilitation measures are addressed, but guarantees of non-repetition related to limiting the actions of the State security forces are left out.
LA PRENSA GRÁFICA compared the bill drafted by the Vice-Presidency and the one presented by organizations of victims of the armed conflict to the Legislative Assembly in October last year.
The result is that the bill is practically the same as if the authors of the government proposal had copied, in their entirety, the articles of the social organizations. The difference lies, however, in the express requests referred to the Armed Forces.
Where the victims elaborated a proposal to avoid the repetition of human rights violations by the army or to guarantee that the archives kept by the FAES on the conflict be made public, the GOES applied a draft and left out all the articles related to the subject.
LA PRENSA GRÁFICA confirmed the veracity of the proposal with two sources who validated its content under the condition of anonymity.
One of the sources from the Legislative Assembly even confirmed that the bill is already in the hands of the deputies of Nuevas Ideas, who are part of the Justice and Human Rights Commission; this, even though it has not been incorporated as a piece of correspondence in any recent plenary session.

La Fuerza Armada de El Salvador (FAES) no estará obligada por ley a abrir los archivos de guerra y estará exenta de ejecutar proyectos de reparación a favor de las víctimas del conflicto armado, pero será parte del Consejo Nacional que articulará y coordinará la ejecución de los mismos en todas las instituciones del Estado.
Así quedará establecido de aprobarse la Ley Especial de Justicia Transicional para Víctimas de Violaciones a Derechos Humanos en el contexto del conflicto armado salvadoreño, un proyecto de ley que el gobierno de Nayib Bukele ha elaborado y del cual LA PRENSA GRÁFICA posee una copia.
La propuesta ha sido elaborada por la vicepresidencia de la república, que encabeza Félix Ulloa, y consiste en 81 artículos, entre los cuales se abordan medidas de reparación, restitución, indemnización y rehabilitación, pero se dejan por fuera las garantías de no repetición relacionadas con poner límites al accionar de los cuerpos de seguridad del Estado.
LA PRENSA GRÁFICA realizó una comparación entre el proyecto de ley elaborado por la vicepresidencia y el presentado por organizaciones de víctimas del conflicto armado a la Asamblea Legislativa en octubre del año pasado.
El resultado es que el proyecto es prácticamente el mismo, como si los autores de la propuesta gubernamental hubiesen copiado, íntegros, los artículos de las organizaciones sociales. La diferencia estriba, sin embargo, en las peticiones expresas referidas a la Fuerza Armada.
Donde las víctimas elaboraron una propuesta para evitar que se repitan violaciones a derechos humanos por parte del ejército o para garantizar que los archivos que la FAES guarda sobre el conflicto sean públicos, ahí el GOES aplicó borrador y dejó por fuera todos los artículos relacionados al tema.
LA PRENSA GRÁFICA confirmó la veracidad de la propuesta con dos fuentes que validaron el contenido del mismo bajo condición de anonimato.
Una de las fuentes, de la Asamblea Legislativa, confirmó inclusive que el proyecto de ley ya se encuentra en poder de los diputados de Nuevas Ideas que integran la Comisión de Justicia y Derechos Humanos; esto, pese a que el mismo no ha sido incorporado como pieza de correspondencia en ninguna plenaria reciente.
