A year ago and in a private act, Vice President Felix Ulloa delivered the draft reforms to the Constitution to President Nayib Bukele, a fact that became known through an official photo on the Government’s social networks almost at midnight on September 15, 2021.
With that same secrecy, the project has remained without major movements and without the president himself or the deputies having shown any intention of disclosing it or debating it with the population or sectors of society.
“In general terms, I see that the project is unfeasible because the level of reforms it proposes is a new Constitution, first. Secondly, it is not a project or a discussion that has arisen from the citizenship”, analyzed Francisco Bertrand Galindo, a constitutional lawyer.
Indeed, the reform proposal was entrusted by President Bukele to Ulloa, who led an ad hoc team to do so. Still, constitutionalists affirm that a Constitution is reformed or changed when there is a popular clamor.
“The Executive has no initiative of law to reform the Constitution because the conceptual basis that the Constitution is designed is that the reforms come from the people. So, there is an error in the way it has been handled. That the Vice President is handling it, it is a project of the Executive, there is a defect of origin”, explained Bertrand Galindo.
The same opinion was expressed by Jonathan Sisco, lawyer of Cristosal: “This kind of reform proposal does not arise from the clamor of the population. When the population wants to change the Constitution, it happens as in Chile, where the population massively demands it, but here the proposal comes from the political power”, he said.
La propuesta de nueva Constitución es “inviable” y con “vicios de origen”
Hace un año y en un acto privado, el vicepresidente Félix Ulloa entregó el proyecto de reformas a la Constitución al presidente Nayib Bukele, hecho que se conoció por una foto oficial en las redes sociales del Gobierno casi a medianoche del 15 de septiembre de 2021.
Con ese mismo secretismo, el proyecto ha permanecido sin mayores movimientos y sin que el mismo presidente o los diputados hayan mostrado intenciones de divulgarlo o debatirlo con la población o los sectores de la sociedad.
“En términos generales veo que el proyecto es inviable, porque el nivel de reformas que está planteando es casi una nueva Constitución, primero. Segundo, no es un proyecto ni una discusión que haya surgido de la ciudadanía”, analizó Francisco Bertrand Galindo, abogado constitucionalista.
En efecto, la propuesta de reforma fue encomendada por el presidente Bukele a Ulloa, quien lideró un equipo ad hoc para hacerlo, pero los constitucionalistas afirman que una Constitución se reforma o se cambia cuando hay un clamor popular.
“El Ejecutivo no tiene iniciativa de ley para reformar la Constitución, porque la base conceptual que está diseñada la Constitución es que las reformas vienen del pueblo. Entonces, allí hay un error de cómo lo han manejado. Que lo esté manejando el vicepresidente, es un proyecto del Ejecutivo, hay un defecto de origen”, explicó Bertrand Galindo.
Lo mismo opinó Jonathan Sisco, abogado de Cristosal: “Esta suerte de propuesta de reforma no surge del clamor de la población. Cuando la población quiere cambiar la Constitución sucede como en Chile que la población masivamente exige eso, pero acá la propuesta viene del poder político.”, dijo.
